2-1231. Penalties; injunction.
Any person violating or failing to comply with any of the
provisions of this act, or any rule and regulation adopted under this act,
shall be guilty of a class B misdemeanor. If any person owning or
operating a facility or equipment used for manufacture, blending, handling
or bulk storage of commercial fertilizer or fertilizer materials fails to
make the changes, additions and alterations necessary to correct any
defects or to correct the deficiencies, within the specified time as
directed, then the county or district attorney of the county in which the
facility or equipment is located shall seek an injunction.
