Article 14.--SALE AND DISTRIBUTION OF AGRICULTURAL SEEDS

      2-1425.   Testing samples; fees; regulations;disposition of moneysreceived; seed examination fee fund.(a) Any person may submit to the state seed laboratory samples ofagricultural seed for germination or purity tests, or both, or otherexamination and receive the test upon paying to the secretary a fee persample, test or examination as the secretary ofagriculture may decide.The secretary of agriculture shall establish by ruleand regulation aschedule of fees for seed testing and examination to be used as the basisof charges. Such fees shall not be less than $5 or more than $45 per testor examination. The secretary may extend credit for work done, and the senderof the sample may be invoiced for such charges from time to time. Testingshall be discontinued for any person who fails to pay such charges within30 days after invoice is issued. The limitation on freetests shall not apply to the state boards, commissions or educational,penal or eleemosynary institutions. The state seed laboratory shall not beobligated to analyze any uncleaned, unprocessed, and other time-consumingsample or any sample which obviously does not meet state seed law requirements.

      (b)   The secretary of agriculture shall remit all moneys received by orfor thesecretary of agriculture under article 14 of chapter 2 of KansasStatutes Annotated,andamendments thereto, to the state treasurer inaccordance with the provisions of K.S.A. 75-4215, and amendments thereto.Upon receipt ofeach such remittance, the state treasurer shalldeposit theentire amountin the state treasury tothe credit of the seedexamination fee fund. All expenditures from such fund shall be made inaccordance with appropriation acts upon warrants of the director ofaccounts and reports issued pursuant to vouchers approved by the secretaryof agriculture or by a person or persons designatedby thesecretary.
