2-2208. Penalties.
(a) Any person violating K.S.A. 2-2203 (a)(1) shall be guilty of a
misdemeanor and upon conviction shall be fined not less than one hundred
dollars and not more than five hundred dollars.
(b) Any person violating any provisions of this act other than K.S.A.
2-2203 (a)(1) or failing to comply with any of the provisions of this act
other than K.S.A. 2-2203 (a)(1) or violating or failing to comply with any
rule or regulation adopted under the provisions of this act, shall be
guilty of a misdemeanor and upon conviction shall be fined not more than
one hundred dollars for the first offense and upon conviction for a
subsequent offense shall be fined not less than one hundred dollars or more
than five hundred dollars for each subsequent offense: Provided, That
any offense committed more than five years after a previous conviction
shall be considered a first offense. The registration of the article with
reference to which the violation occurred shall terminate automatically
upon entry of judgment by the court against the violator. An article the
registration of which has been terminated may not again be registered
unless the article, its labeling, and other material required to be
submitted appear to the secretary, or an authorized representative of the
secretary, to comply with all the requirements of this act.
(c) Notwithstanding any other provisions of this section, in case any
person, with intent to defraud, uses or reveals information relative to
formulas of products acquired under authority of K.S.A. 2-2204, he or she
shall be fined not more than five hundred dollars or imprisoned for not
more than one year or both.
