Article 22.--AGRICULTURAL CHEMICALS

      2-2208.   Penalties.(a) Any person violating K.S.A. 2-2203 (a)(1) shall be guilty of amisdemeanor and upon conviction shall be fined not less than one hundreddollars and not more than five hundred dollars.

      (b)   Any person violating any provisions of this act other than K.S.A.2-2203 (a)(1) or failing to comply with any of the provisions of this actother than K.S.A. 2-2203 (a)(1) or violating or failing to comply with anyrule or regulation adopted under the provisions of this act, shall beguilty of a misdemeanor and upon conviction shall be fined not more thanone hundred dollars for the first offense and upon conviction for asubsequent offense shall be fined not less than one hundred dollars or morethan five hundred dollars for each subsequent offense: Provided, Thatany offense committed more than five years after a previous convictionshall be considered a first offense. The registration of the article withreference to which the violation occurred shall terminate automaticallyupon entry of judgment by the court against the violator. An article theregistration of which has been terminated may not again be registeredunless the article, its labeling, and other material required to besubmitted appear to the secretary, or an authorized representative of thesecretary, to comply with all the requirements of this act.

      (c)   Notwithstanding any other provisions of this section, in case anyperson, with intent to defraud, uses or reveals information relative toformulas of products acquired under authority of K.S.A. 2-2204, he or sheshall be fined not more than five hundred dollars or imprisoned for notmore than one year or both.
