2-2461. Penalties; injunction.
(a) Any person other than a certified private applicator violating or failing
to comply with any provision of this act or any authorized rule or regulation
of the secretary shall be deemed guilty of a class A
misdemeanor.
Each separate violation shall constitute a separate offense.
(b) Any certified private applicator who violates any of the provisions
of this act or any authorized rules and
regulations of the secretary
shall be deemed guilty of a misdemeanor, and upon conviction shall be punished
by a fine of not less than $100 and
not more than
$500. Each day of operation after
notice shall
constitute
a separate offense.
(c) The district courts of Kansas shall have jurisdiction to restrain
violations of this act by injunction without the institution of criminal
proceedings. Said injunction shall be issued without bond.
