Article 24.--PEST CONTROL

      2-2473.   Same; factors to examine in area development; pesticidemanagement area technical advisory committee; composition and duties thereof.(a) The pesticide management areas shall be developed byexamination of the following factors:

      (1)   Precipitation;

      (2)   topography;

      (3)   soil type;

      (4)   depth to the watertable; and

      (5)   other factors as the secretary deems relevant.

The areas shall be designated as permitted, modified or prohibited for theuse of certain types of pesticides as determined by the pesticidemanagement plan for the management area. The order of the secretarydesignating such pesticide management area shall define specificallythe boundaries of the pesticide management area and shall indicatespecifically the pesticide management plan for the area. Pesticide management plans mayinclude provisions for the handling or release of pesticides, including butnot limited to the application, mixing, loading, storage, disposal ortransportation and guidelines for the best management practices.

      (b)   When considering whether to establish such pesticide managementareas, the secretary shall consult with a pesticide management areatechnical advisory committeecomposed of a representative or representatives of each of the following:(1) Kansas department of health and environment appointed by the secretaryof health and environment; (2) Kansasdepartment of wildlife and parks appointed by the secretary of wildlifeand parks; (3) Kansas state university appointed by the president ofKansas state university; (4) Kansaswater authority appointed by the chairperson of the Kansas water authority;(5) conservation commission appointed by the chairperson of the stateconservation commission; (6) Kansas geological survey appointed by the state geologist;and (7) other persons the secretary determines to have beneficialinformation to the establishment of such areas as appointed by thesecretary. This technical advisorycommittee shall assist the secretary in the development of the proposedboundaries of the pesticide management area and the proposed plan for thepesticide management area.
