Article 24.--PEST CONTROL

      2-2480.   Uniformity of pesticide law; state has exclusive jurisdiction.(a) On and after the effective date of this act, theprovisionsof the Kansas pesticide law, and anyrules and regulations promulgated thereunder relating to pesticide sale or use,including, but not limited to, application of pesticides, training andcertification of pesticide applicators, storage of pesticides, transportationof pesticides and disposal of pesticides within the state of Kansas shall beapplicable and uniform throughout this state and in all cities, counties andpolitical subdivisions therein. No local authority shall enact or enforce anylaw, ordinance, rule, regulation or resolution in conflict with, in additionto, or supplemental to, the provisions of the Kansas pesticide law unlessexpressly authorized by law to do so. Any law, ordinance, rule, regulation orresolution in conflict with, in addition to, or supplemental to, the provisionsof the Kansas pesticide law is hereby declared to be invalid and of no effect.Any amendment to the Kansas pesticide law or any amendment of the rules andregulations promulgated thereunder, shall supersede and preempt theconflicting, additional or supplementalprovisions of any law, ordinance, rule, regulation or resolution enacted by anycity, county or other political subdivision of this state.

      (b)   Nothing in this section shall be construed to preempt or otherwise limitthe authority of any city, county or political subdivision therein to adoptand enforce zoning regulations, fire codes or hazardous waste disposalrestrictions.

      (c)   This act is supplemental to and shall become a part of the Kansaspesticide law.
