20-349. Budget for district court expenses payableby counties,preparation; approval of budget.The chief judge in each judicial district shall beresponsible for thepreparation of the budget to be submitted to the board of county commissionersof each county. The board of county commissioners shall then have finalauthority to determine and approve the budget for district court operationspayable by their county. The judicial administrator of the courts shallprescribe the form upon which such budgets shall be submitted. The budget shallinclude all expenditures payable by the county for operations of the districtcourt in such county. A separate budget shall be prepared for each countywithin the district and the judges of the district court shall approve thebudget for the county in which such judges are regularly assigned prior tosubmission of such budget to the board of county commissioners. Thecompensation to be paid to district court personnel excluded from thejudicial personnel classification system pursuant to subsection (b) ofK.S.A. 20-162, and amendments thereto, shall be listed in the budget as aseparate item for each job position. After the amount of such districtcourt budget is established, the expenditures under such budget, other thanexpenditures for job positions contained in the budget, shall be under thecontrol and supervision of the chief judge, subject tosupreme courtrules relating thereto, and the board of county commissioners shall approve allclaims submitted by the chief judge within the limits ofsuch districtcourt budget.Thefinancial affairs of the district court in each county including, but notlimited to, nonexpendable trust funds, law library funds and court trusteeoperations shall be subject to audit pursuant to the provisions of K.S.A.75-1122, and amendments thereto, as part of the annual county audit.Reports of fiscal or managerial discrepancies or noncompliance with applicablelaw shall be made to the judicial administrator of the courts as well as theboard of county commissioners.
