20-356. Additional judges or divisions of court; payment of costsand expenses from county general fund, no-fund warrants or generalobligation bonds.Any county in which additional divisions of the district court areestablished or in which additionaldistrict magistrate judge positions are established, may pay all of thecosts and expenses incidental to or arising out of the establishment,operation and maintenance of the facilities for such additionaldivisions or positions during the year in which they are established,out of the general fund of the county or if it does not have sufficientmoneys available in its general fund for such purpose, such county ishereby authorized and empowered to issue during such year, no-fundwarrants for the purpose of providing funds to pay all expenses, costs,salaries payable by any such county and costs incidental to or arisingout of the establishment, maintenance and operation of such division orposition, including the providing and equipping of courtrooms and othernecessary offices and costs incidental thereto or arising therefrom orwhenever the board of county commissioners considers it advisable, suchboard may issue general obligation bonds of the county to pay all of thecosts and expenses incidental to or arising out of the establishment,operation and maintenance of facilities for such additional divisions orpositions other than costs incurred for payment of salaries, and for thepurpose of redeeming no-fund warrants issued under the authority of thissection except no-fund warrants issued for payment of salaries. Suchno-fund warrants shall be issued in the manner and form, bear interestand be redeemed as prescribed by K.S.A. 79-2940, and amendments thereto,except they may be issued without the approval of the statecourt of tax appeals and without the notation required by K.S.A.79-2940, and amendments thereto.
If such no-fund warrants are issued under the provisions of this act,the county issuing the same shall make a tax levy at the first taxlevying period after such warrants are issued sufficient to pay the sameand the interest thereon. Any such countymay make expenditures from its general fundduring the year in which the said divisions or positions of the courtare created for any of the purposes hereinbefore described, even thoughsuch expenditures were not included in the county budget for that year.
General obligation bonds issued under the authority of this sectionshall be issued in the manner prescribed by the general bond law butshall not be subject to or within any bonded debt limitation prescribedby any other law of this state and shall not be considered or includedin applying any other law limiting bonded indebtedness.
