Article 10.--OPERATION UNDER INFLUENCE OF ALCOHOL OR DRUGS

     
3-1002.   Operation of aircraft under influence of certain drugs unlawful.
It is unlawful and punishable as provided in K.S.A. 3-1003 for any person
who is under the influence of any narcotic, hypnotic, somnifacient or stimulating
drug or who is under the influence of any other drug to a degree which renders
such person incapable of safely operating an aircraft to operate an aircraft
within this state. The fact that any person charged with a violation of
this section is or has been entitled to use such drug under the laws of
this state shall not constitute a defense against any charge of violating this section.
