Article 10.--OPERATION UNDER INFLUENCE OF ALCOHOL OR DRUGS

      3-1002.   Operation of aircraft under influence of certain drugs unlawful.It is unlawful and punishable as provided in K.S.A. 3-1003 for any personwho is under the influence of any narcotic, hypnotic, somnifacient or stimulatingdrug or who is under the influence of any other drug to a degree which renderssuch person incapable of safely operating an aircraft to operate an aircraftwithin this state. The fact that any person charged with a violation ofthis section is or has been entitled to use such drug under the laws ofthis state shall not constitute a defense against any charge of violating this section.
