Chapter 8. Counterterrorism and Security Council

Council established
Sec. 1. The counterterrorism and security council is established.

Membership; nonvoting members
Sec. 2. (a) The council consists of the following members:
(1) The lieutenant governor.
(2) The executive director.
(3) The superintendent of the state police department.
(4) The adjutant general.
(5) The state health commissioner.
(6) The commissioner of the department of environmentalmanagement.
(7) The director of the Indiana state department of agriculture.
(8) The chairman of the Indiana utility regulatory commission.
(9) The commissioner of the Indiana department oftransportation.
(10) The executive director of the Indiana criminal justiceinstitute.
(11) The commissioner of the bureau of motor vehicles.
(12) A local law enforcement officer or a member of the lawenforcement training academy appointed by the governor.
(13) The speaker of the house of representatives or the speaker'sdesignee.
(14) The president pro tempore of the senate or the presidentpro tempore's designee.
(15) The chief justice of the supreme court.
(16) The director of the department of natural resources or, ifdesignated by the director, the deputy director who manages thebureau of law enforcement and administration.
(17) The state veterinarian.
(18) The chief information officer of the office of technology.
(b) The members of the council under subsection (a)(13), (a)(14),and (a)(15) are nonvoting members.
(c) Representatives of the United States Department of Justicemay serve as members of the council as the council and theDepartment of Justice may determine. Any representatives of theDepartment of Justice serve as nonvoting members of the council.

Chair
Sec. 3. The lieutenant governor shall serve as the chair of the
council and in this capacity report directly to the governor.

Duties
Sec. 4. (a) The council shall do the following:
(1) Develop a strategy in concert with the department toenhance the state's capacity to prevent and respond to terrorism.
(2) Develop a counterterrorism plan in conjunction withrelevant state agencies, including a comprehensive needsassessment.
(3) Review each year and update when necessary the plandeveloped under subdivision (2).
(4) Develop in concert with the department a counterterrorismcurriculum for use in basic police training and for advancedin-service training of veteran law enforcement officers.
(5) Develop affiliates of the council to coordinate local effortsand serve as the point of contact for the council and the UnitedStates Department of Homeland Security.
(6) Develop a plan for sharing intelligence information acrossmultiple federal, state, and local law enforcement and homelandsecurity agencies.
(b) The council shall report periodically its findings andrecommendations to the governor.

Staff
Sec. 5. (a) The executive director may employ staff for thecouncil, subject to the approval of the governor.
(b) The executive director shall serve as:
(1) the central coordinator for counterterrorism issues; and
(2) the state's point of contact for:
(A) the Office for Domestic Preparedness in the UnitedStates Department of Justice; and
(B) the United States Department of Homeland Security.

Council expenses
Sec. 6. (a) The expenses of the council shall be paid fromappropriations made by the general assembly.
(b) Money received by the council as a grant or a gift isappropriated for the purposes of the grant or the gift.

Member expenses; per diem
Sec. 7. (a) Each member of the council who is not a stateemployee is not entitled to the minimum salary per diem provided by
IC 4-10-11-2.1(b). The member is, however, entitled toreimbursement for travel expenses as provided in IC 4-13-1-4 andother expenses actually incurred in connection with the member'sduties as provided in the state policies and procedures established bythe Indiana department of administration and approved by the budgetagency.
(b) Each member of the council who is a state employee but whois not a member of the general assembly is entitled to reimbursementfor travel expenses as provided under IC 4-13-1-4 and other expensesactually incurred in connection with the member's duties as providedin the state policies and procedures established by the Indianadepartment of administration and approved by the budget agency.
(c) Each member of the council who is a member of the generalassembly is entitled to receive the same per diem, mileage, and travelallowances paid to legislative members of interim study committeesestablished by the legislative council. Per diem, mileage, and travelallowances paid under this subsection shall be paid fromappropriations made to the legislative council or the legislativeservices agency.

Vote required to take action
Sec. 8. The affirmative votes of a majority of the voting membersof the council are required for the council to take action on anymeasure, including final reports.

Receipt of confidential law enforcement information
Sec. 9. (a) The council may receive confidential law enforcementinformation from the state police department, the Federal Bureau ofInvestigation, or other federal, state, or local law enforcementagencies.
(b) For purposes of IC 5-14-1.5 and IC 5-14-3, informationreceived under subsection (a) is confidential.

Cooperation of state agencies
Sec. 10. All state agencies shall cooperate to the fullest extentpossible with the council and the executive director to implement thischapter.
