Chapter 1. Grievance Procedure

"Administrative act" defined
Sec. 1. As used in this chapter, "administrative act" means anaction, decision, directive, omission, policy, practice, procedure, orrule of the department or one (1) of its employees.

Submission of grievances; minimum requirements
Sec. 2. The commissioner shall implement a departmentalprocedure in which a committed person may submit grievancesarising out of the administrative acts of the department that affectthat person. Although the procedure should encourage flexibility andinformality in the resolution of grievances, it must be consistent withthe following minimum requirements:
(1) A committed person shall be informed of the grievanceprocedure as part of his orientation.
(2) The department must periodically communicate to acommitted person the rules and policies affecting him.
(3) The department shall keep the person reasonably informedas to the status and ultimate disposition of his grievance.
(4) The department may not undertake any act or practice thatwould discipline a person for, or otherwise discourage or limithim from, utilizing the grievance procedure.

Utilization of committed persons in grievance procedure
Sec. 3. The procedure established under section 2 of this chaptermay provide for the utilization of committed persons in the grievanceprocedure.

Procedure
Sec. 4. For purposes of IC 4-22-2, the term "procedure" as used inthis section relates solely to internal policy and procedure not havingthe force of law.
