Chapter 2. Boot Camp Criteria and Program Administration

Purpose of program
Sec. 1. The boot camp program for youthful offenders isestablished within the department to:
(1) improve the chances of correction and successful return tothe community for youthful offenders committed to thedepartment by:
(A) preventing the offender's association with older andmore experienced criminals; and
(B) providing the offenders with skills for living andrehabilitation; and
(2) provide a commitment alternative to the department and thecourts for dealing with youthful offenders who are consideredto be capable of successful integration into the community afterreceiving rigorous training for that task.

Number accommodated; personnel
Sec. 2. (a) The boot camp must accommodate at least one hundred(100) but not more than one hundred twenty (120) youthful offenderswho are designated by the department to participate in the program.
(b) The department shall employ appropriately trained personnelto administer the boot camp.

Facilities; separation
Sec. 3. The department shall develop and implement the bootcamp at a facility or facilities determined by the department.However, a boot camp facility used by the department must beseparated by means of fencing or distance from a facility that housesnonparticipants in boot camp.

Selection of offenders; rules
Sec. 4. The department shall adopt rules under IC 4-22-2concerning criteria for the selection by the department of youthfuloffenders to participate in boot camp, including the following:
(1) A participant must not have a physical limitation that wouldpreclude participation in strenuous activity.
(2) A participant must not be mentally impaired.

Services provided by camp; rules Sec. 5. The department shall adopt rules under IC 4-22-2 thatensure the boot camp provides the following for participants:
(1) A paramilitary environment emphasizing discipline,physical development, value modification, treatmentintervention, and meaningful assignments.
(2) An opportunity for a participant to:
(A) learn self-discipline, self-respect, and personalaccountability;
(B) acquire a positive work ethic and job skills; and
(C) form habits of cleanliness and hygiene.
(3) Treatment and counseling, if necessary, for the following:
(A) Drug and alcohol abuse.
(B) Emotional or mental problems.
(4) Education, including the following:
(A) Remedial programs.
(B) Programs in preparation for a state of Indiana generaleducational development (GED) diploma under IC 20-20-6.
(C) Life skills.
(5) Vocational assessment designed to evaluate a participant'sskill level and aptitudes for vocational and technical skilldevelopment.

Administration of camp; rules
Sec. 6. The department shall adopt rules under IC 4-22-2 foradministering the boot camp, including the following:
(1) Disciplinary procedures.
(2) Program requirements.
(3) A system for classifying and assigning participants.
(4) Procedures for the systematic review of participants,including:
(A) continuing performance evaluations by all staff whohave direct contact with a participant;
(B) regularly scheduled review and evaluation of aparticipant by a facility review committee; and
(C) progress reports, based upon review and evaluation of aparticipant, to be submitted every thirty (30) days to theprobation department for the sentencing court.
(5) Establishment of automated case files capable of interfacingwith other offender information services provided by thedepartment.
(6) Other procedures necessary for the administration of bootcamp.

Admission date
Sec. 7. The department shall admit new participants on the first
working day of each month.

Number admitted
Sec. 8. The department shall admit not more than forty (40)participants a month.

Length of participation
Sec. 9. (a) A participant shall participate in boot camp for exactlyone hundred twenty (120) consecutive days.
(b) A participant does not earn:
(1) credit under any statute or rule; or
(2) any other benefit;
that reduces the period of boot camp participation below one hundredtwenty (120) days.

Summary punishment; record and statement of fact
Sec. 10. The department shall maintain a written record andstatement of fact concerning summary punishment of a participant.Copies of the record and statement shall be sent to the probationdepartment for the sentencing court.

Withdrawal or expulsion; notification of court
Sec. 11. (a) A participant may voluntarily withdraw from the bootcamp.
(b) The department shall notify the sentencing court of aparticipant who voluntarily withdraws or is expelled from boot camp.

Expulsion; grounds; statement to court
Sec. 12. (a) A participant may be expelled from boot camp ifprogram personnel find the participant:
(1) has committed misconduct under rules adopted by thedepartment; or
(2) has failed to adapt to the boot camp regimen and program.
(b) If a participant is expelled from boot camp, the departmentshall submit to the sentencing court a statement describing thecircumstances leading to the expulsion of the participant.

Failure to complete camp; return to correctional facility Sec. 13. A youthful offender who fails to successfully completeboot camp shall be returned to the general population of acorrectional facility designated by the department to serve theremainder of the youthful offender's sentence.

Approved nonparticipation; completion time
Sec. 14. If a youthful offender is unable to participate in bootcamp due to circumstances approved by the department, the timespent in nonparticipation may be excluded from the calculation of thetime required to successfully complete boot camp.

Sentence served before placement; completion
Sec. 15. Any part of a sentence of a youthful offender servedbefore placement in boot camp may not be counted toward programcompletion.
