    Chapter 4.5. International Prisoner Transfer or Exchange UnderTreaty

Application of chapter
    Sec. 1. This chapter applies if a treaty is in effect between theUnited States and a foreign country providing for the transfer orexchange of a convicted person to the country in which the person isa citizen or national.

Authorization of transfer or exchange
    Sec. 2. The governor may, subject to the terms of the treaty,authorize the commissioner to:
        (1) allow for the transfer or exchange of a convicted person; and
        (2) take any other action necessary to execute the terms of thetreaty.

Sentence
    Sec. 3. If the commissioner transfers a person from the custody ofthe department under this chapter, the transfer does not affect thesentence under which the person was committed to the department.The person's sentence continues to run during the period that theperson is in the custody of the appropriate officials of the UnitedStates or the foreign country to which the person is transferred. Theperson is subject to return to the custody of the department under thischapter if the person has not completed the person's sentence.
