Chapter 2. Commission on Rehabilitation Services

"Commission" defined
Sec. 1. As used in this chapter, "commission" refers to thecommission on rehabilitation services established by section 2 of thischapter.

Establishment
Sec. 2. The commission on rehabilitation services is established.

Membership
Sec. 3. (a) The commission consists of at least fourteen (14)members appointed by the governor as follows:
(1) Three (3) members representing advocacy groups for:
(A) individuals with:
(i) physical;
(ii) cognitive;
(iii) sensory; and
(iv) mental;
disabilities; or
(B) parents, guardians, or advocates of individuals withdisabilities who have difficulty or who are unable torepresent themselves.
(2) At least one (1) member representing current or formerapplicants for vocational rehabilitation services or recipients ofvocational rehabilitation services.
(3) At least one (1) representative of the statewide IndependentLiving Council.
(4) At least one (1) representative of a parent training andinformation center established by the individuals withdisabilities education act.
(5) At least one (1) representative of the Indiana protection andadvocacy services agency.
(6) At least one (1) representative of community rehabilitationprogram service providers.
(7) Four (4) representatives of business, industry, and labor.
(8) The director of the division of disability and rehabilitativeservices shall serve as an ex officio member.
(9) A vocational rehabilitation counselor shall serve as an exofficio nonvoting member.
(b) Not more than seven (7) members of the commission may befrom the same political party.
(c) At least fifty-one percent (51%) of the commission must bepersons with disabilities who are not employees of the division of
disability and rehabilitative services.

Members; terms of office
Sec. 4. (a) A member of the commission serves a term of three (3)years.
(b) A member may not serve more than two (2) consecutive terms.

Members; vacancies
Sec. 5. The governor shall fill a vacancy on the commission byappointing an individual for the unexpired term.

Election of officers
Sec. 6. The commission shall elect the necessary officers from thecommission's membership.

Powers and duties
Sec. 7. The commission shall do the following:
(1) Advise the division concerning the division's performancein the following areas:
(A) Eligibility and order of selection.
(B) Scope, extent, and effectiveness of services.
(C) Functions of state agencies in addition to vocationalrehabilitation affecting individuals in achievingrehabilitation goals.
(2) Advise the secretary of family and social services and thedivision of disability and rehabilitative services concerning thestate plan, applications, and the strategic plan.
(3) Review and analyze the effectiveness and consumersatisfaction with the functions of the agencies dealing withpersons with disabilities and with vocational rehabilitationservices.
(4) Prepare and submit an annual report to the governor and therehabilitation services administration commissioner on thestatus of vocational rehabilitation programs in Indiana.
(5) Coordinate with other councils in Indiana.
(6) Advise and provide for coordination and workingrelationships between the state agency and the IndependentLiving Council and Independent Living centers.

Meetings
Sec. 8. (a) The commission shall meet at least four (4) times ayear upon the call of the commission's presiding officer.
(b) The meetings of the commission must comply withIC 5-14-1.5.

Members; per diem; travel expenses
Sec. 9. A member of the commission is entitled to the following:
(1) The minimum salary per diem as provided inIC 4-10-11-2.1(b) for each day spent on the official business ofthe commission.
(2) Reimbursement for travel and other expenses as provided inthe state travel policies and procedures established by theIndiana department of administration and approved by thebudget agency.

Advisory committees; per diem and expenses of committeemembers
Sec. 10. (a) The commission may appoint advisory committeesnecessary to advise the director and the bureau.
(b) A member of an advisory committee appointed under thissection is entitled to the following:
(1) The minimum salary per diem as provided inIC 4-10-11-2.1(b) for each day spent on the official business ofthe advisory committee.
(2) Reimbursement for traveling and other expenses as providedin the state travel policies and procedures established by theIndiana department of administration and approved by thebudget agency.

Staff and personnel
Sec. 11. The commission, in conjunction with the division ofdisability and rehabilitative services, may employ staff and otherpersonnel as necessary.
