Chapter 2.5. Eligibility of Qualified Aliens, Lawful PermanentResidents, and Illegal Aliens for TANF

Qualified aliens
Sec. 1. A person who:
(1) is not a citizen of the United States;
(2) is a qualified alien, as defined in 8 U.S.C. 1641(b); and
(3) meets all other eligibility criteria under this chapter;
is eligible for the TANF program, subject to 8 U.S.C. 1612 and 8U.S.C. 1613.

Illegal aliens
Sec. 3. A person who is in the United States without permissionof the United States Citizenship and Immigration Services is notentitled to receive any assistance under this article.

Child born in the United States
Sec. 4. A child who:
(1) is born in the United States to a person described in section1 or 3 of this chapter; and
(2) otherwise meets the requirements for eligibility under thisarticle;
is eligible to receive assistance under this article.

Violation of federal law
Sec. 5. Any provision of this chapter that violates a federal law orfederal regulation is void.
