    Chapter 5. Temporary Assistance for Needy Families; Educationand Employment Training

Application
    
Sec. 1. Sections 1 through 5 of this chapter apply to an individualwho is:
        (1) less than eighteen (18) years of age and not enrolled in aneducational or a vocational training program; or
        (2) a parent of a dependent child who has not graduated fromhigh school or earned a:
            (A) high school equivalency certificate; or
            (B) state of Indiana general educational development (GED)diploma;
and is a member of a family that receives TANF.

"State of Indiana general educational development (GED)diploma"
    
Sec. 2. As used in this chapter, "state of Indiana generaleducational development (GED) diploma" means the state credentialissued to a qualified applicant under IC 20-20-6.

Cooperation in developing educational and vocational trainingservices and facilities
    
Sec. 3. The division, the department of education, and the publicschools shall cooperate as follows:
        (1) With all public and private educational and vocationaltraining or retraining agencies or facilities operating in Indiana.
        (2) In developing necessary education and vocational trainingor retraining services and facilities to improve the skills of theparents in families receiving assistance and services under thisarticle, for whom jobs are not immediately available, or thatwill provide education, training, and experience for parents andfor children nearing adulthood who lack the skills required foremployment opportunities that are or may become available.

Continuation of family assistance grant; educational programparticipation; vocational training or retraining; additionalpayments
    
Sec. 4. (a) The division shall require parents for whom educationor training is suitable and available to do the following for the

continuation of the family assistance grant:
        (1) Participate in an educational program designed to enhanceopportunities for employment.
        (2) Attend a vocational training or retraining facility.
    (b) Additional money may be made available and payments madefor vocational training and other expenses to persons furnishing thevocational training or the person receiving the training.

Division plan for vocational and educational training in eachcounty
    
Sec. 5. The division shall adopt a plan for furnishing in eachcounty:
        (1) vocational training; and
        (2) educational training;
that allows an individual described in section 1 of this chapter todevelop the skills to obtain a state of Indiana general educationaldevelopment (GED) diploma.

Payment for training and other expenses; source of funds;maximum monthly amounts under IC 12-14-2
    
Sec. 6. Payment for training and other expenses must be made bythe division from money appropriated for the training and otherservices even though expenditures may exceed the maximumestablished under IC 12-14-2.

State or federal higher education awards; determination of incomeand resources when applying for assistance
    
Sec. 7. Except as provided by federal law, if an individualreceives a state or federal higher education award that is paid directlyto an approved postsecondary educational institution for theindividual's benefit:
        (1) the individual is not required to report the award as incomeor as a resource of the individual when applying for assistancefor a dependent child under this chapter; and
        (2) the award may not be considered as income or a resource ofthe individual in determining initial or continuing eligibility forassistance for a dependent child under this chapter.
