Chapter 6. Temporary Assistance for Needy Families; Funeral andCemetery Expenses

Funeral director's expense payments
Sec. 1. (a) This section applies upon the death of either of thefollowing:
(1) A recipient who is receiving assistance as a dependent child.
(2) A parent of the recipient.
(b) Unless otherwise determined by the director, the division shallpay six hundred dollars ($600) for the funeral director's expenses ofthe decedent if the following conditions exist:
(1) The estate of the deceased is insufficient to pay the funeraldirector's expenses.
(2) The person legally responsible for the burial of the deceasedis unable to pay the funeral director's expenses.

Cemetery expenses payment
Sec. 2. Unless otherwise determined by the director, in additionto the amount paid under section 1 of this chapter, not more than fourhundred dollars ($400) shall be paid for the cemetery's expenses forthe following:
(1) To cover provision of burial rights if necessary.
(2) Opening and closing a burial plot and provision of an outercontainer.
(3) Service required by the cemetery authorities.

Contributions excluded in determining amount paid to funeraldirector
Sec. 3. An amount not exceeding a combined total of sevenhundred fifty dollars ($750) that is contributed by:
(1) friends;
(2) relatives; and
(3) the resources of the deceased;
may not be considered when determining the amount to be paid tothe funeral director for expenses under this chapter. However, theresources of the deceased may not be used if the deceased hasprepaid funeral expenses that were excluded as a resource forMedicaid eligibility under IC 12-15-2.

Contributions excluded in determining cemetery expenses payment
Sec. 4. An amount not exceeding a combined total of two hundred
dollars ($200) that is contributed by:
(1) friends;
(2) relatives; and
(3) the resources of the deceased;
may not be considered when determining the amount to be paid tothe cemetery for expenses under this chapter. However, the resourcesof the deceased may not be used if the deceased has prepaid funeralexpenses that were excluded as a resource for Medicaid eligibilityunder IC 12-15-2.

Sworn claims indicating expenses; filing
Sec. 5. The funeral director and the cemetery representative shallfile a sworn claim with the division indicating expenses incurred dueto the death of a recipient.
