    Chapter 20. Payment of Township Assistance Claims

Certification, audit, and payment of claim
    
Sec. 1. (a) If a township trustee, as administrator of townshipassistance, grants township assistance to an indigent individual or toany other person or agency on a township assistance order asprovided by law or obligates the township for an item properlypayable from township assistance money, the claim against thetownship must be:
        (1) itemized and sworn to as provided by law;
        (2) accompanied by the original township assistance order,which must be itemized and signed; and
        (3) checked with the records of the township trustee, asadministrator of township assistance, and audited and certifiedby the township trustee.
    (b) The township trustee shall pay claims against the township fortownship assistance in the same manner that other claims against thetownship are paid. The township trustee, when authorized to payclaims directly to vendors, shall pay a claim within forty-five (45)days. The township trustee shall pay the claim from:
        (1) any balance standing to the credit of the township againstwhich the claim is filed; or
        (2) from any other available fund from which advancements canbe made to the township for that purpose.

Borrowing to pay claims
    
Sec. 2. (a) If money is not available for the payment of townshipassistance claims under section 1 of this chapter, the township boardshall appeal to borrow money under IC 12-20-24.
    (b) This subsection does not apply to a county having aconsolidated city. If the township board does not appeal to borrowmoney under IC 12-20-24 or if an appeal fails, the board ofcommissioners may borrow money or otherwise provide the money.If the county commissioners determine to borrow the money orotherwise provide the money, the county fiscal body shall promptlypass necessary ordinances and make the necessary appropriations toenable this to be done, after determining whether to borrow moneyby any of the following:
        (1) A temporary loan against taxes levied and in the process ofcollection.
        (2) The sale of county township assistance bonds or othercounty obligations.
        (3) Any other lawful method of obtaining money for thepayment of township assistance claims.
    (c) This subsection applies only to a county having a consolidated

city. If a township board does not appeal to borrow money underIC 12-20-24 or if an appeal fails, the board of commissioners shallborrow money or otherwise provide the money. The county fiscalbody shall promptly pass necessary ordinances and make thenecessary appropriations to enable this to be done, after determiningwhether to borrow money by any of the following methods:
        (1) A temporary loan against taxes levied and in the process ofcollection.
        (2) The sale of county township assistance bonds or othercounty obligations.
        (3) Any other lawful method of obtaining money for thepayment of township assistance claims.

Purchase and payment forms
    
Sec. 4. The state board of accounts shall prescribe the forms forthe purchase of and payment for township assistance items.

Sec. 5. Payment for water services must be in accordance withIC 12-20-16-3.
