Chapter 8. Legal Residence as Condition for Receipt of TownshipAssistance

"Resident" defined
Sec. 1. For purposes of this chapter, an individual is a "resident"of a township or county if the individual:
(1) has located in the township or county; and
(2) intends to make the township or county the individual's soleplace of residence.

Relief for residents
Sec. 2. If an individual is a resident of a township or county, thetownship or county shall relieve and support the individual if theindividual is poor and in need of relief.

Intent to become resident; determination
Sec. 3. (a) The township trustee may deny township assistance toan individual if the township trustee determines that the individualdoes not intend to make the township or county the individual's soleplace of residence.
(b) The township trustee may consider all relevant informationthat supports or refutes the individual's intent to make the townshipor county the individual's sole place of residence, except the lengthof time the individual has been located in the township or county.

Continuance of legal residence
Sec. 4. A residence legally acquired continues until the legalresidence is lost or defeated by acquiring a new legal residence or bywillful and uninterrupted absence from the township in which legalresidence has been gained.

Determination of legal residence; factors discounted
Sec. 5. Time spent in a penal institution, public or privatecharitable or benevolent institution, hospital, fraternal home, or inany place while serving in the armed forces of the United States maynot be counted in determining legal residence in Indiana.

Loss of legal residence due to state or federal service Sec. 6. An individual may not be considered to have lost a legalresidence in Indiana because of an absence that is due to business ofthe state or of the United States.

Assistance notwithstanding inability to establish place of legalsettlement
Sec. 7. If the township trustee, as administrator of townshipassistance, is unable to ascertain and establish the place of legalresidence of a poor individual within the township, the townshiptrustee shall proceed to provide assistance to the individual in thesame manner as other poor individuals are provided assistance.
