    Chapter 11. Involuntary Treatment by Division for Alcoholics andDrug Abusers

Involuntary commitment; individuals who may not be committed
    
Sec. 1. (a) Except as provided in subsection (b), an individual whois:
        (1) an alcoholic;
        (2) incapacitated by alcohol; or
        (3) a drug abuser;
may be involuntarily committed to the care of the division underIC 12-26.
    (b) A drug abuser who is charged with or convicted of an offensethat makes the individual ineligible to make an election for treatmentunder IC 12-23-6 may not be involuntarily committed undersubsection (a).

Treatment as condition of parole
    
Sec. 2. (a) Acceptance of treatment for drug abuse under thesupervision of the division may be made a condition of parole underIC 11-13-3-4. Failure to comply with treatment may be treated as aviolation of parole.
    (b) The division shall establish the conditions under which aparolee is accepted for treatment.
    (c) A parolee may not be placed under supervision of the divisionfor treatment unless the division accepts the individual for treatment.
    (d) The division shall make periodic progress reports regardingeach parolee to the appropriate parole authority and shall reportfailures to comply with the prescribed treatment program.
