    Chapter 13. Miscellaneous Lawful Activity Relating to ControlledSubstances

Individuals under influence of controlled substance in public place;lawful circumstances
    
Sec. 1. It is lawful for an individual to be under the influence ofa controlled substance in a public place if the individual can presentpositive proof of the following:
        (1) The individual is under the care of the division, acommunity mental health center, a managed care provider, or alicensed physician.
        (2) The controlled substance constitutes medical treatmentauthorized by state and federal law.

Prescribing, dispensing, or administering controlled substances fortreatment of drug abuse; conditions
    
Sec. 2. It is lawful to prescribe, dispense, or administer controlledsubstances for the treatment of drug abuse if the following conditionsare met:
        (1) The controlled substances are used for the treatment ormaintenance of a drug abuser.
        (2) The treatment or maintenance is medically indicated.
        (3) The treatment or maintenance is prescribed by a physicianas a part of a rehabilitation program approved by the directorand dispensed in compliance with the regulations for thedispensing of controlled substances.
