    Chapter 16. Program on Drug Abuse

Symptoms and conditions constituting drug abuse; determinationby director
    
Sec. 1. For the purpose of this chapter, the director, in accordancewith sound medical and psychiatric knowledge, may determine whatsymptoms and conditions must exist to say that an individual abusesdrugs.

Powers and duties of division
    
Sec. 2. The division may do the following:
        (1) Provide for the promotion, establishment, coordination, andconduct of unified local programs of prevention, diagnosis,treatment, and rehabilitation in the field of drug abuse incooperation with federal, state, local, and private agencies.
        (2) Survey and analyze the state's needs and formulate acomprehensive plan for the long range development of localcommunity treatment programs through the utilization of state,federal, local, and private resources for the prevention andcontrol of drug abuse.
        (3) With the approval of the budget agency, make agreementsconcerning local community treatment programs, includingagreements with public and private agencies, to do or cause tobe done whatever is necessary, desirable, or proper to carry outthe purposes and objectives of this chapter within the amountsmade available by appropriation, gift, grant, devise, or bequest.
        (4) Establish and operate local community rehabilitation centersand other local facilities that the division considers necessary ordesirable for the care, treatment, and rehabilitation of drugabusers.
        (5) Approve facilities and services for the local communitytreatment, care, or rehabilitation of drug abusers.
        (6) With the approval of the budget agency, accept on behalf ofthe state a gift, grant, devise, or bequest.
        (7) Adopt rules under IC 4-22-2 to implement this chapter.

Drug abuse treatment and rehabilitation centers; establishment
    
Sec. 3. The division may establish drug abuse treatment andrehabilitation units:
        (1) independently within local communities;
        (2) as part of the community mental health plan; or
        (3) in cooperation with local authorities or associations for thepurpose of study, rehabilitation, and treatment necessary for thecontrol and prevention of drug abuse.As added by P.L.2-1992, SEC.17.
