Chapter 10. Guardian for Estate of Patient Committed to StateInstitution

Appointment; representation by attorney general
Sec. 1. If:
(1) it becomes necessary to appoint a guardian for the estate ofan individual who has been committed to a state institution; and
(2) the estate of the individual does not exceed three hundreddollars ($300);
the attorney general shall represent the individual in securing theappointment of a guardian for the individual's estate.

Petition; appointment
Sec. 2. Upon presentation of a petition for the appointment of aguardian, the court may appoint either of the following as theguardian of the individual's estate:
(1) The superintendent of the state institution to which theindividual has been committed.
(2) Another individual employed by the state institution in anadministrative capacity.

Filing of application for appointment
Sec. 3. An application for the appointment of a guardian underthis chapter must be filed in the circuit or superior court in the countyin which the state institution is located.

Fees or costs not to be charged
Sec. 4. Fees or costs may not be charged in a proceeding underthis chapter, including a fee for the guardian or the attorney for theguardian.
