    Chapter 6. Provision of Clothing for Patients

"Fund" defined
    Sec. 1. As used in this chapter, "fund" refers to the institutionclothing fund established by this chapter.

Requisition of clothing needs
    Sec. 2. When the superintendent of a state institution accepts apatient, the superintendent shall indicate the clothing needs of thepatient in a requisition.

Financial responsibility to court
    Sec. 3. The responsible parties are responsible to the court forsupplying a patient's clothing unless financially unable to supply theclothing.

Duties of circuit court clerk of admitting county
    Sec. 4. If clothing can be supplied by a responsible party or anyother willing person, the clerk of the circuit court of the county fromwhich the patient is admitted shall do the following:
        (1) Notify the responsible party or the other willing person ofthe clothing needs of the patient.
        (2) Have an ample supply of suitable clothing sent with thepatient.

Compliance with requisition
    Sec. 5. Clothing furnished under section 4 of this chapter mustsubstantially comply with the requisition sent by the superintendentunder section 2 of this chapter.

Charge of admitting county; limit
    Sec. 6. (a) If clothing is not otherwise furnished at the time apatient is admitted to a state institution, the superintendent shallfurnish the clothing and charge the county from which the patientwas admitted.
    (b) A superintendent may not charge a county under subsection(a) more than four hundred dollars ($400).

Responsibility to supply clothing after admission
    Sec. 7. After a patient has been admitted to a state institution, itis the responsibility of:
        (1) the patient;
        (2) the payee of any type of benefit received on behalf of apatient; or
        (3) the responsible parties of the patient;
to supply clothing requested by the superintendent for the patient.

Furnishing of clothing by superintendent
    Sec. 8. If a patient in a state institution is not otherwise suppliedwith clothing, the superintendent shall furnish the clothing.

Charging of county for clothing superintendent furnishes; limit
    Sec. 9. (a) If a superintendent furnishes clothing under section 8of this chapter, the superintendent shall charge the county fromwhich the patient was admitted.
    (b) A charge made by a superintendent for a patient under thissection may not be more than three hundred dollars ($300) per year.
    (c) A charge made by a superintendent under this section is a debtdue the state institution.

Charges made under this chapter; requisites
    Sec. 10. All charges made under this chapter must be:
        (1) signed by the superintendent; and
        (2) forwarded for payment to the auditor of the county fromwhich the patient was admitted according to the followingschedule:
            (A) All charges accruing between January 1 and June 30 ofeach year shall be forwarded to the county auditor on orbefore October 1 of that year.
            (B) All charges accruing between July 1 and December 31of each year shall be forwarded to the county auditor beforeApril 1 of the following year.

Warrant; payment of charge
    Sec. 11. (a) Upon receipt of a charge under section 10 of thischapter, the county auditor shall draw a warrant on the treasurer ofthe county for payment of the charge.
    (b) A charge shall be paid out of the money of the countyappropriated for that purpose.    (c) The fiscal body of each county shall annually appropriatesufficient money to pay the accounts.
    (d) A payment by a county under this section shall be transmittedto the superintendent of the billing state institution.

Monthly transmittal of collections to state auditor
    Sec. 12. The superintendent of a state institution shall transmiteach month the collections received under this chapter to the auditorof state.

Institution clothing fund established
    Sec. 13. (a) The institution clothing fund is established.
    (b) The auditor of state shall place money received under section12 of this chapter in the fund.
    (c) The fund may be used only for the purpose of crediting therespective state institutions for the amounts expended by the stateinstitutions for clothing for which the counties were billed.

Delinquent charges; certification to state auditor; payment
    Sec. 14. (a) If a county does not pay a charge made under thischapter within six (6) months after the date the charge is delivered tothe county auditor, the superintendent of the state institution shallcertify to the auditor of state that the money is due.
    (b) After receiving the superintendent's certification undersubsection (a), the auditor of state shall:
        (1) withhold from any money due to the county a sum equal tothe amount certified by the superintendent; and
        (2) pay the amount withheld under subdivision (1) into the fundas provided in section 13 of this chapter.
