    Chapter 2. Suspension or Revocation of License

Grounds
    
Sec. 1. The director may suspend or revoke a license issued underthis article on any of the following grounds:
        (1) Violation of a provision of this article or the rules adoptedunder IC 12-21-2-3(5).
        (2) Permitting, aiding, or abetting the commission of an illegalact in the institution.
        (3) Conduct or practice found by the director to be detrimentalto the welfare of individuals in the institution.

Complaint
    
Sec. 2. To suspend or revoke a license, the director must file acomplaint stating facts constituting grounds for revocation orsuspension.

Notice of hearing
    
Sec. 3. A licensee is entitled to notice of not less than thirty (30)days of the time and place for a hearing before the director on thecomplaint. The notice shall be sent by registered mail to the licenseeat the address shown in the licensee's application.

Sec. 4. The licensee is entitled to be represented by legal counselat the hearing.

Director; authority to suspend license after hearing
    
Sec. 5. The director, after a hearing, may suspend or revoke thelicense.

Conditions to be met to resume operations following licensesuspension
    
Sec. 6. If the director suspends a license, the director may alsorecommend the conditions to be met by the licensee during theperiod of suspension to entitle the licensee to resume operation of theinstitution on the existing license.

Order entered in accordance with suspension or revocation
    
Sec. 7. If the director suspends or revokes a license, the directorshall enter an order in accordance with the suspension or revocationin which the grounds of the suspension or revocation are set forth.

Holding case under advisement; requirements of licensee to avoidsuspension or revocation; order; compliance by licensee
    
Sec. 8. (a) The director may, after a hearing, hold a case underadvisement and make a recommendation of the requirements to bemet by the licensee to avoid suspension or revocation. The directorshall enter an order accordingly and notify the licensee of the findingby registered mail.
    (b) If the licensee complies with the order and proves that fact tothe satisfaction of the director, the director shall enter an ordershowing satisfactory compliance and dismissing the case because ofthe compliance.
