Chapter 3. Appeal Procedure
IC 12-25-3-1
Appeals by applicants or licensees; court to which appeal taken;notice; bond
Sec. 1. A licensee or an applicant for a license aggrieved by anaction of the director may appeal the action to the circuit or superiorcourt in the county in which the institution in question is located oris proposed to be located by filing a notice and bond in the amountof two hundred dollars ($200) for the payment of costs in the officeof the circuit court clerk of the county.

Notification of director that appeal has been taken
Sec. 2. The circuit court clerk shall notify the director that theappeal has been taken.

Certification to court of copies of complaint and order orapplication and order
Sec. 3. The director shall cause to be certified to the appropriatecourt a copy of:
(1) the complaint and the order for a suspension or revocation;or
(2) the application and order of refusal of a license.

Docketing of case; parties; no further pleadings necessary
Sec. 4. (a) The case shall be docketed as a civil action, with theapplicant or licensee as the plaintiff and the director as the defendant.

Jurisdiction of court; order
Sec. 5. The court has jurisdiction to the extent that courts exercisejurisdiction over administrative bodies and may enter an order eithersustaining the action of the director or setting the action aside.

Certification of decision to director
Sec. 6. The circuit court clerk shall certify to the director a copyof the decision of the court.

Appeal by party aggrieved by decision of court
Sec. 7. An appeal may be made by the aggrieved party from thedecision of the court.
