Chapter 5. Reimbursement of Expenses From County HomeResident's Estate

Charges against estates
Sec. 1. If an individual who:
(1) is being supported at public expense in a county home; or
(2) has died while a resident of a county home;
is found to have an estate of any kind that is not needed for thesupport, in whole or in part, of the husband, wife, children, parents,grandparents, grandchildren, brothers, or sisters of the individual, theamount of expense incurred by the county for the treatment andmaintenance of the individual shall be charged against theindividual's estate, both during the individual's lifetime and after theindividual's death.

Collections
Sec. 2. The reimbursement obtained under section 1 of thischapter shall be collected quarterly by the superintendent of thecounty home in which the individual resides or resided, at a rate ofnot more than seven dollars ($7) per week. The money received shallbe paid quarterly into the county general fund. The superintendent orexecutive officer may, under the direction of the board ofcommissioners of the county, bring suit against the estate of anindividual described in section 1 of this chapter failing to makepayment as required in this chapter. If a judgment is obtained in asuit brought under this section, the judgment constitutes a lienagainst the part of the estate that is described in the complaint.
