Chapter 2. Family and Social Services Bodies

"Body" defined
Sec. 1. As used in this chapter, "body" refers to an entitydescribed in section 3 of this chapter.

Sec. 2. As used in this chapter, "member" refers to a member ofa body.

Application of chapter
Sec. 3. Unless otherwise provided by a statute, this chapter appliesto the following:
(1) The family and social services committee established byIC 12-8-3-2.
(2) The following advisory councils:
(A) The division of disability and rehabilitative servicesadvisory council.
(B) The division of family resources advisory council.
(C) The division of mental health and addiction advisorycouncil.
(3) A body:
(A) established by statute for a division; and
(B) whose enabling statute makes this chapter applicable tothe body.

Service on advisory councils
Sec. 3.5. Up to five (5) individuals appointed by the secretary toserve on an entity not described in section 3(2) of this chapter maybe appointed to serve concurrently on an advisory council describedin section 3(2) of this chapter. However, an individual may not serveconcurrently on more than one (1) advisory council described insection 3(2) of this chapter.

Member appointed to fixed term; limitations
Sec. 4. (a) This section applies only to a member who by statuteis appointed to a fixed term. (b) The term of an individual serving as a member begins on thelatter of the following:
(1) The day the term of the member whom the individual isappointed to succeed expires. If the individual does not succeeda member, the member's term begins as provided in subdivision(2).
(2) The day the individual is appointed.
(c) The term of a member expires on July 1 of the second yearafter the expiration of the term of the member's immediatepredecessor. If the member has no immediate predecessor, the termof the member expires on July 1 of the second year after themember's term began.
(d) A member may be reappointed for a new term. A reappointedmember is the member's own:
(1) successor for purposes of subsection (b); and
(2) immediate predecessor for purposes of subsection (c).

Officeholder as member; tenure
Sec. 5. (a) This section applies only to an individual who servesas a member because of an office the individual holds.
(b) The individual serves as a member until the individual nolonger holds the office.

Vacancies
Sec. 6. The appointing authority of a member shall appoint anindividual to fill a vacancy in the office of the member.

Appointment of presiding officer
Sec. 7. Except as provided in another statute, the governor shallappoint a voting member of the body to be the presiding officer ofthe body.

Voting member
Sec. 8. Unless otherwise provided by a statute, a member is avoting member.

Quorum
Sec. 9. A majority of the voting members of the body constitutesa quorum.

Majority vote
Sec. 10. The affirmative vote of a majority of the voting membersof the body is required for the body to take any action.

Compensation of members
Sec. 11. (a) A member who is not a state employee is entitled toboth of the following:
(1) The minimum salary per diem provided byIC 4-10-11-2.1(b).
(2) Reimbursement for travel expenses and other expensesactually incurred in connection with the member's duties, asprovided in the state travel policies and procedures establishedby the Indiana department of administration and approved bythe budget agency.
(b) A member who is a state employee is entitled toreimbursement for travel expenses and other expenses actuallyincurred in connection with the member's duties, as provided in thestate travel policies and procedures established by the Indianadepartment of administration and approved by the budget agency.
(c) A member who is a member of the general assembly is entitledto receive the same per diem, mileage, and travel allowances paid tomembers of the general assembly serving on interim studycommittees established by the legislative council.

Agenda
Sec. 11.5. In addition to the requirements of IC 5-14-1.5, theoffice of the secretary or a division will make a good faith effort toensure that members of any body subject to this chapter receive acopy of an agenda at least forty-eight (48) hours before any meetingof the body.

Expiration of chapter
Sec. 12. This chapter expires June 30, 2011.
