    Chapter 8. Divisions and Directors

IC 12-8-8-1
Appointment; termination
    Sec. 1. Subject to the approval of the governor, the secretary:
        (1) shall appoint each director; and
        (2) may terminate the employment of a director.

Chief administrator; responsibility
    Sec. 2. (a) A director is the chief administrator of the director'sdivision.
    (b) A director is responsible to the secretary for the operation andperformance of the director's division.

Appointing authority
    Sec. 3. A director is the appointing authority for the director'sdivision.

Rules
    Sec. 4. (a) Except as provided in subsection (c), a director mayadopt rules under IC 4-22-2 relating to the operation of the director'sdivision and to implement the programs of the director's division.
    (b) Except as provided in subsection (c), whenever a division isrequired to adopt rules under IC 4-22-2, the director of the divisionis the statutory authority that adopts the rules.
    (c) Rules adopted by a director must be approved by the familyand social services committee established by IC 12-8-3-2 beforesubmission to the attorney general under IC 4-22-2-31. However,nothing in this section prevents a director from presenting a proposedrule to the family and social services committee established byIC 12-8-3-2 for the committee's review and recommendations beforethe adoption of the rule under IC 4-22-2-29 and approval of the ruleby the committee under IC 12-8-1.

Administrative review
    Sec. 5. (a) A director is the ultimate authority under IC 4-21.5 forpurposes of the operation of the director's division and the programsof the director's division.
    (b) The director shall consult with the secretary on issues offamily, social services, or health policy arising in a proceeding underIC 4-21.5.As added by P.L.2-1992, SEC.2.

Budget
    Sec. 6. A director is responsible for development and presentationof the budget of the director's division.
