    Chapter 13. Enforceable Operating Agreement Program

Rules
    Sec. 1. The air pollution control board may adopt rules underIC 4-22-2 to establish categories of sources or facilities that may beeffectively restricted through specific requirements established bythe rules to emit less than the amount of air pollutants for which aTitle V air operating permit is required.

Establishment; applicability
    Sec. 2. For categories established under section 1 of this chapter,the department shall recommend rules to establish an enforceableoperating agreement program. The program established under thissection may apply to some or all of the sources or facilities withinthe categories. Rules adopted under this section must be approved bythe United States Environmental Protection Agency.

Annual report
    Sec. 3. (a) The department shall provide an annual report to thefollowing:
        (1) The board.
        (2) The environmental quality service council.
    (b) The report must include a summary of the:
        (1) reviews conducted; and
        (2) agreements approved;
in the preceding year under this chapter.
