    Chapter 5. Release of Hazardous Materials

Rules regarding secondary containment structures at storage ortransfer facilities; release contingency plans
    
Sec. 1. The board shall adopt rules under IC 4-22-2 to require thefollowing:
        (1) The construction or installation of secondary containmentstructures at facilities in which hazardous materials are storedor transferred for the purpose of preventing released hazardousmaterials from entering surface water or groundwater.
        (2) The development by the owner or operator of each facilityat which hazardous materials are stored or handled of a plan forresponding to the release of a hazardous material at that facility.
        (3) The rules must be consistent with applicable safety and firecode laws.

Exemptions
    
Sec. 2. The rules adopted under section 1 of this chapter mustprovide exemptions for the following:
        (1) A facility that is subject to similar requirements under otheradministrative rules or under state law, federal law, or federalregulations.
        (2) Hazardous materials that are stored or transferred asproducts packaged for distribution to and use by the public.
        (3) An above ground storage tank that:
            (A) is used to store oils or petroleum products; and
            (B) has a capacity of not more than six hundred sixty (660)gallons.
        (4) Tanks subject to regulations adopted by the administrator ofthe United States Environmental Protection Agency under 42U.S.C. 6991 through 6991i, as amended.
        (5) Tanks subject to IC 13-23.
