    Chapter 9. Requirements for Purchases by State Agencies

Department of administration to ensure state agency compliancewith program
    Sec. 1. The Indiana department of administration shall ensure thatacquisitions of video display devices by state agencies comply withor are not subject to this article.

State contractor compliance with program
    Sec. 2. State agency solicitation documents must specify that theprospective responder is required to cooperate fully in providingreasonable access to the prospective responder's records anddocuments to demonstrate compliance with this article.

Sanctions on state contractor that violates program
    Sec. 3. A person awarded a contract by a state agency forpurchase or lease of video display devices that is found to be inviolation of this article is subject to the following sanctions:
        (1) The contract is void if the Indiana department ofadministration determines that the potential adverse effect to thestate from voiding the contract is exceeded by the benefitobtained from voiding the contract.
        (2) If the attorney general establishes that any money, property,or benefit was obtained by a contractor as a result of violatingthis article, a court may, in addition to any other remedy, orderthe forfeiture of the unlawfully obtained money, property, orbenefit.
