    Chapter 24. Host Agreement in a County Without Zoning

County without zoning may enter into host agreement
    Sec. 1. With respect to a landfill or landfill expansion located orproposed to be located in the unincorporated area of a county thatdoes not zone under IC 36-7-4, the county and another person mayenter into a host agreement under this chapter.

Municipality in county without zoning may enter into hostagreement
    Sec. 2. With respect to a landfill or landfill expansion located orproposed to be located in a municipality in a county that does notzone under IC 36-7-4, the municipality and another person may enterinto a host agreement under this chapter.

Duties under host agreement of person who enters into theagreement with the county or municipality
    Sec. 3. A host agreement under this chapter must provide that theperson that enters into the host agreement with the county ormunicipality agrees, in exchange for permission from the county ormunicipality to construct or operate a landfill in the county ormunicipality, to do one (1) or more of the following during the termof the host agreement:
        (1) Make one (1) or more payments in designated amounts tothe county or municipality.
        (2) Construct, improve, or maintain infrastructure that supportsor is otherwise related to the landfill.
        (3) Provide to the county or municipality other considerationthat supports or is otherwise related to the landfill.

Use by county or municipality of payments under host agreement
    Sec. 4. A county or municipality that receives a payment undersection 3(1) of this chapter may use the revenue only for theconstruction, improvement, or maintenance of infrastructure thatsupports or is otherwise related to the landfill.
