Chapter 6. State Report Regarding Pollution Prevention

Annual report
Sec. 1. Each year the commissioner shall prepare and submit tothe governor and the general assembly a report regarding thepollution prevention information gathered under this article,including:
(1) a description of the operations and activities of the programsunder this article; and
(2) recommendations the commissioner has for legislativeaction.
A report submitted under this section to the general assembly mustbe in an electronic format under IC 5-14-6.

Contents of annual report
Sec. 2. The report required by this chapter must include at leastthe following:
(1) A quantitative assessment of statewide pollution preventionprogress among all types of industries.
(2) An identification of regulations and government policiesthat are inhibiting pollution prevention and opportunities inexisting regulatory programs to promote and assist in pollutionprevention, including reductions in the use of toxins inproduction and commerce.
(3) An assessment of how programs under this article havepromoted and assisted pollution prevention and the costs andbenefits to government and industry of those programs.
(4) A statement concerning the identification of opportunitiesand development of priorities for research and development inpollution prevention techniques, economic analyses, andmanagement techniques useful in supporting pollutionprevention. The state report may not include informationconsidered by a business to be a trade secret of that business.
(5) Recommendations concerning incentives and policiesneeded to:
(A) encourage investment in research and development inpollution prevention; and
(B) make greater use of programs established under thisarticle.

Draft report; final report
Sec. 3. (a) Before the commissioner submits a report to thegovernor and the general assembly under section 1 of this chapter,
the commissioner shall make a draft version of the report availablefor at least forty-five (45) days for comment by the:
(1) public; and
(2) liaison advisory panels established under IC 13-27-2.
(b) The final report must respond to public comments submittedduring the comment period.
