    Chapter 10. Utility Easements

Permit requirement
    Sec. 1. A person may not erect or construct a utility, telephone, ortelegraph line upon or across:
        (1) a state park;
        (2) a state forest;
        (3) a state game preserve;
        (4) land acquired by the state and set aside for use by the publicas a scenic or historic place; or
        (5) that part of a public highway right-of-way that passesthrough a state park, a state forest, a state game preserve, orland acquired by the state and set aside for use by the public asa scenic or historic place;
unless the person has a permit from the director to erect or constructthe line.

Issuance of permit
    Sec. 2. The director may issue to any person, without charge, apermit to erect or construct a utility, telephone, or telegraph line asdescribed in section 1 of this chapter under the rules and restrictionsthat the director considers necessary:
        (1) for the protection and preservation of the natural scenicconditions of the land; or
        (2) to prevent the line from interfering with or obstructing theuse and enjoyment of the property by the public.

Prohibited easements
    Sec. 3. A person may not construct or erect a utility, telegraph, ortelephone line as described in section 1 of this chapter in violation ofany of the rules and restrictions of a permit issued under this chapter.

Violations
    Sec. 4. A person who violates this chapter commits a Class Cinfraction. Each day that such a violation exists constitutes a separateoffense.
