Transfer of interests of the state to county park and recreationalboard
Sec. 1. The governor, auditor of state, and director may, on behalfof and in the name of the state, transfer and convey to theTippecanoe County park and recreational board, Tippecanoe County,Indiana, all rights, title, and interest of the state, includingmaintenance and operating equipment, in the Tippecanoe BattleGround Memorial at Battle Ground, Indiana. The grantee shall act asthe agent of the general assembly in the performance of the generalassembly's constitutional duty to preserve the Tippecanoe BattleGround.

Conditions of transfer
Sec. 2. The transfer under section 1 of this chapter is conditionedon the following:
(1) That when the recipient is in full possession, the recipientshall forevermore maintain, develop, and use the TippecanoeBattle Ground Memorial, by whatever name, as a general parkand recreation area dedicated to the preservation of theTippecanoe Battle Ground.
(2) That the recipient of the property does not have the right tosell, lease, or in any way transfer the control of the property, inwhole or in part, to a person, a firm, a party, or an agency ofgovernment, except for use as a general park and recreation areadedicated to the preservation of the Tippecanoe Battle Ground.
(3) That a subsequent owner, lessee, or controller of theproperty does not have the right to use or cause the property tobe used for a purpose other than a general park and recreationarea dedicated to the preservation of the Tippecanoe BattleGround.
(4) That should the property, in whole or in part, ever be usedfor other than the stated purpose, the director may, withapproval of the governor, cause the property, in whole, to revertto the status of ownership before February 16, 1972.

Permanent enclosure and preservation of battle ground
Sec. 3. This chapter provides for the permanent enclosure andpreservation of the Tippecanoe Battle Ground as required by Article15, Section 10, of the Constitution of the State of Indiana.
