    Chapter 17. Mussels License

"Resident" defined
    
Sec. 1. As used in this chapter, "resident" means a person who:
        (1) has continuously resided in Indiana for at least threehundred sixty-five (365) consecutive days immediately beforeapplying for a license under this chapter; and
        (2) possesses:
            (A) an Indiana motor vehicle operator's license; or
            (B) an identification card;
        issued by the bureau of motor vehicles.

License requirement
    
Sec. 2. A person may not:
        (1) take mussels or mussel shells from the water of the state; or
        (2) ship, offer to sell, buy, or offer to buy mussels or musselshells taken from the water of the state;
without having a license issued by the department.

Issuance; fees
    
Sec. 3. The department may issue the following license to take,ship, sell, buy, or export mussels or mussel shells taken from thewater of the state under rules adopted under IC 4-22-2 for theprotection of mussels and upon payment of the following applicablelicense fees:
        (1) A resident yearly license to take, ship, and sell mussels ormussel shells, one hundred dollars ($100).
        (2) A resident yearly license to buy, ship, sell, or export musselsor mussel shells, one thousand five hundred dollars ($1,500).
        (3) A nonresident yearly license to buy, ship, sell, or exportmussels or mussel shells, five thousand dollars ($5,000).

Violations
    
Sec. 4. A person who violates section 2 of this chapter commitsa Class A misdemeanor.
