    Chapter 31. Shooting Preserves

IC 14-22-31-1
Application for license
    
Sec. 1. A person who:
        (1) owns;
        (2) holds; or
        (3) controls by lease for a term of not less than five (5) years;
a contiguous tract of land containing an area of not less than onehundred (100) acres and not more than six hundred forty (640) acres,and who desires to establish a license shooting preserve must applyto the division for a license.

Fee
    
Sec. 2. An application for a license under section 1 of this chaptermust be accompanied by a fee of one hundred dollars ($100) with theapplication.

Restrictions
    
Sec. 3. A shooting preserve may not be established within adistance of one (1) mile of a state owned game refuge or state publichunting ground. Duck shooting is not permitted if:
        (1) prohibited by a rule adopted under IC 14-22-2-6; or
        (2) wild ducks, geese, or other migratory game birds frequentthe area where the captive reared and properly marked mallardducks are to be held, released, and flighted for shooting.

Inspection; issuance of license
    
Sec. 4. Upon receipt of an application, the department shall do thefollowing:
        (1) Inspect the following:
            (A) The proposed shooting preserve.
            (B) The facilities for propagating the game birds or exoticmammals.
            (C) The cover.
            (D) The capability of the applicant to maintain such anoperation.
        (2) If found feasible, approve the application and issue a licenseto the applicant.

Expiration of license    Sec. 5. A license issued under this chapter expires April 30 ofeach year.

Posting and boundaries
    
Sec. 6. Upon receipt of a license, the licensee shall post thelicensed area at intervals of not more than five hundred (500) feetwith signs to be prescribed by rule. The boundaries of the shootingpreserve shall be clearly defined by fences of at least one (1) strandof wire.

Animals that may be propagated and offered for hunting
    
Sec. 7. A person issued a license under section 4 of this chaptermay propagate and offer for hunting the following animals that arecaptive reared and released:
        (1) Pheasant, quail, chukar partridges, properly marked mallardducks, and other game bird species that the departmentdetermines by rule.
        (2) Species of exotic mammals that the department determinesby rule.

Hunting license or special license required
    
Sec. 8. (a) A person may not take game birds and exotic mammalson a shooting preserve unless the person has a hunting licenserequired under this article, except nonresidents of Indiana who mustpossess a special license to shoot on licensed shooting preserves.
    (b) The department:
        (1) shall issue special licenses; and
        (2) may appoint owners or managers of shooting preserves asagents to sell special licenses.
    (c) A special license expires December 31 of the year issued.
    (d) The fee for a special license is eight dollars and seventy-fivecents ($8.75). All fees shall be deposited in the fish and wildlifefund.

Season
    
Sec. 9. A person may take wild animals from a shooting preserveonly during September, October, November, December, January,February, March, or April.

Bill of sale    Sec. 10. The licensee of a shooting preserve shall issue a bill ofsale designating game birds or exotic mammals lawfully taken uponthe shooting preserve. The bill of sale must accompany all gamebirds and exotic mammals removed from the shooting preserve. Thelicensee shall retain a copy of all bills of sale issued to personsremoving game birds or exotic mammals from the shooting preserve.The bills of sale are subject to inspection by the fish and wildlifedivision at any time.

Daily register; records
    
Sec. 11. (a) The licensee of a shooting preserve must keep a dailyregister to show the following:
        (1) The number of wild animals and the species released andtaken from the shooting preserve each day.
        (2) The number of hunters participating.
    (b) An annual computation of the record:
        (1) shall be sent to the department on May 10 each year; and
        (2) shall be filed under oath as to the number and species ofwild animals released and taken.
    (c) Failure to keep and forward the records to the department issufficient cause for:
        (1) revocation of the license for the shooting preserve; or
        (2) refusal to issue a license for the following year.

Inspections by department
    
Sec. 12. (a) The following must be available to the department forinspection:
        (1) The daily records.
        (2) The pens.
        (3) The wild animals.
        (4) The shooting preserves.
    (b) An inspection of a shooting preserve shall be conducted underthis chapter and rules adopted under IC 14-22-2-6. The departmentshall consult with the state veterinarian if the inspection reveals apotential animal health threat that contravenes programs for theprevention, control, or eradication of diseases in domestic animals.

Falsification of reports
    
Sec. 13. (a) A licensee may not falsify a report that must be keptunder this chapter.
    (b) A license may not be issued to a licensee who is convicted ofviolating subsection (a) or IC 14-2-7-10(i) (repealed).

Carnivores prohibited
    
Sec. 14. (a) A licensee may not import or keep carnivores.
    (b) The license of a licensee who is convicted of violatingsubsection (a) shall be revoked.
