Chapter 32. Game Bird and Exotic Mammal Regulation
IC 14-22-32-1
Applicability of chapter
Sec. 1. This chapter does not apply to the following:
(1) Conservation officers or other law enforcement officers.
(2) Game birds or exotic mammals in shooting preserveslicensed under IC 14-22-31.
(3) A person who takes a feral exotic mammal when the feralexotic mammal is causing damage to property that is owned orleased by the person.
(4) A person who is authorized by the department underextraordinary circumstances to take an exotic mammal.

Prohibitions
Sec. 2. A person may not do any of the following:
(1) Offer a game bird or an exotic mammal for hunting,trapping, or chasing by a person using a weapon or device thatis not a shotgun, muzzle loading gun, handgun, or bow andarrow.
(2) Hunt, trap, or chase a game bird or an exotic mammal witha weapon or device that is not a shotgun, muzzle loading gun,handgun, or bow and arrow.

Violations
Sec. 3. A person who knowingly or intentionally violates section2 of this chapter commits a Class A misdemeanor.

Issuance of shooting preserve license precluded
Sec. 4. A person who violates section 2(1) of this chapter may notbe issued a license under IC 14-22-31.

Orders to dispose of game birds or exotic mammals
Sec. 5. If a person violates section 2(1) of this chapter, thedepartment shall enter a recommended order to dispose of any gamebird or exotic mammal the person owns, keeps, harbors, or otherwisepossesses. Before the order becomes a final determination of thedepartment, a hearing must be held under IC 4-21.5-3. The hearingshall be conducted by an administrative law judge for thecommission. The determination of the administrative law judge is afinal agency action under IC 4-21.5-1-6.As added by P.L.1-1995, SEC.15.

Adoption of rules
Sec. 6. The department shall adopt rules under IC 4-22-2 toproperly administer this chapter consistent with any applicablefederal statutes and regulations.

Other actions not precluded
Sec. 7. This chapter does not preclude the state or another personfrom bringing other actions under the Indiana Code.
