Chapter 8. Game Bird Habitat Restoration Stamp

"Fund" defined
Sec. 1. As used in this chapter, "fund" refers to the game birdhabitat restoration fund established by this chapter.

"Game bird" defined
Sec. 2. As used in this chapter, "game bird" means pheasant,quail, grouse, mourning dove, and wild turkey.

"Stamp" defined
Sec. 3. As used in this chapter, "stamp" refers to the game birdhabitat restoration stamp provided by this chapter.

Stamps; requirement; form
Sec. 4. (a) A person may not hunt or take a game bird withinIndiana without having a game bird habitat restoration stamp issuedby the department. The stamp must be in the possession of eachperson hunting or taking a game bird. The licensee shall validate thestamp with the signature of the licensee on the hunting license onwhich the electronically generated form of the stamp is attached.
(b) The department shall do the following:
(1) Determine the form of the stamp and may create and sellcommemorative game bird habitat restoration stamps.
(2) Furnish the commemorative stamps or the electronicallygenerated form of the stamps to a clerk of the circuit court orthe clerk's designated depositories for issuance or sale in thesame manner as hunting licenses are issued or sold underIC 14-22-11.

Stamps; issuance, fee, and expiration
Sec. 5. An electronically generated stamp shall be issued to eachhunting license applicant or holder upon request and the payment ofa fee of six dollars and seventy-five cents ($6.75). Each stampexpires on March 31 of the year following issuance.

Fund
Sec. 6. (a) The game bird habitat restoration fund is established asa dedicated fund.
(b) The department shall administer the fund. The director mayexpend the money in the fund exclusively for the purpose ofrestoring the habitat of the various game birds in Indiana.
(c) The proceeds from the sale of stamps shall be deposited in thefund.
(d) Money in the fund does not revert to the state general fund atthe end of a state fiscal year. If the fund is abolished, the contentsrevert to the fish and wildlife fund.

Powers and duties of department
Sec. 7. (a) The department shall contract for the development ofgame bird habitats in Indiana. Each contract must:
(1) be for at least three (3) years; and
(2) provide a plan for the development of habitat for at least one(1) species of game bird.
(b) The department may seek the cooperation of federal agenciessuch as the Agricultural Stabilization and Conservation Service orthe Natural Resources Conservation Service in the development ofhabitat plans and compensation for habitat plans. Monetarycompensation may not exceed one hundred dollars ($100) per acreper year and each contract may provide that the site be open forregulated public game bird hunting.
(c) The department may purchase land in Indiana from willingsellers for the development of game bird habitats.
