    Chapter 9. Treatment Affidavits and Special Authorizations

Affidavit filed by person served with notice or order
    Sec. 1. (a) If, as a result of an inspection under this article, awritten notice or order is issued for the treatment, removal, ordestruction of a plant or element of beekeeping, the division mayrequire that an affidavit be filed by the person to whom the notice ororder was issued.
    (b) The affidavit described in subsection (a) shall be completed ona commission form and must specify the following:
        (1) That the terms of the notice or order have been satisfied tothe best of the affiant's ability.
        (2) That the work was effective for the purpose prescribed.

Permit to move plants or beekeeping elements containing pests orpathogens
    Sec. 2. A person may not cause the movement of a plant or anelement of beekeeping that contains a pest or pathogen without apermit issued by the division director. A permit issued under thissection must provide adequate measures to assure thatcommunication will not occur to areas that are not afflicted with apest or pathogen.

Designation of persons to perform inspections
    Sec. 3. The director may appoint an agent, an employee, or arepresentative of the United States Department of Agriculture toperform, on behalf of the department, an inspection authorized bythis article.
