    Chapter 6. Flood Control; Approval of Plans

IC 14-28-6-1
Requirements for approval
    
Sec. 1. Notwithstanding any other law to the contrary, a personmay not construct, install, or undertake a work of any nature that isdesigned to regulate or control the streams or other water of Indianafor the purpose of preventing floods caused by excessiveprecipitation or otherwise unless the plans meet the followingconditions:
        (1) The plans are submitted to and approved by the department.
        (2) The plans are found to be feasible and will ultimatelyconstitute a part of an integrated plan for the entire state or adesignated major watershed.
        (3) The plans are not disadvantageous to any other section ofIndiana.

Approval of federal government plans
    
Sec. 2. If the federal government or an agency of the federalgovernment develops plans for flood control affecting Indiana or apart of Indiana, the department may:
        (1) approve the plans; and
        (2) permit the use of the plans in the control of floods inIndiana.
