    Chapter 13. Reclamation Fees

Fees paid by all operators
    Sec. 1. All operators of surface coal mining operations subject tothis article shall pay to the department for deposit in the naturalresources reclamation division fund established by IC 14-34-14-2 areclamation fee of five and a half cents ($0.055) per ton of coalproduced.

Fees paid by underground mining operators
    Sec. 2. All operators of underground coal mining operationssubject to this article shall pay to the department for deposit in thenatural resources reclamation division fund established byIC 14-34-14-2 a reclamation fee of three cents ($0.03) per ton of coalproduced.

Payments of fees
    Sec. 3. The fees required by sections 1 through 2 of this chaptershall be paid:
        (1) concurrently with the federal reclamation fee under thefederal Surface Mining Control and Reclamation Act of 1977(30 U.S.C. 1232); and
        (2) not later than thirty (30) days after the end of each calendarquarter.
