    Chapter 2. Establishment of the Department

Indiana state department of agriculture established
    Sec. 1. The Indiana state department of agriculture is established.

Director's authority
    Sec. 2. The director is the chief executive and administrativeofficer of the department.

Duties of the department
    Sec. 3. The department shall do the following:
        (1) Provide administrative and staff support for the following:
            (A) The state fair board for purposes of carrying out thedirector's duties under IC 15-13-5.
            (B) The Indiana corn marketing council for purposes ofadministering the duties of the director under IC 15-15-12.
            (C) The Indiana organic peer review panel under IC 15-15-8.
            (D) The Indiana dairy industry development board forpurposes of administering the duties of the director underIC 15-18-5.
            (E) The Indiana land resources council under IC 15-12-5.
            (F) The Indiana grain buyers and warehouse licensingagency under IC 26-3-7.
            (G) The Indiana grain indemnity corporation underIC 26-4-3.
            (H) The division.
            (I) The agricultural biomass infrastructure grant programunder IC 15-11-11.
        (2) Administer the election of state fair board members underIC 15-13-5.
        (3) Administer state programs and laws promoting agriculturaltrade.
        (4) Administer state livestock or agriculture marketing grantprograms.
        (5) Administer economic development efforts for agriculture bydoing the following:
            (A) Promoting value added agricultural resources.
            (B) Marketing Indiana agriculture to businessesinternationally.
            (C) Assisting Indiana agricultural businesses withdeveloping partnerships with the Indiana economicdevelopment corporation.
            (D) Soliciting private funding for selective economicdevelopment and trade initiatives.            (E) Providing for the orderly economic development andgrowth of Indiana's agricultural economy.
            (F) Facilitating the use of biomass (as defined inIC 15-11-11-0.7) and algae production systems to generaterenewable energy.

Promotion of E85 based fuel
    Sec. 4. The department shall work with:
        (1) automobile manufacturers to improve awareness andlabeling of E85 base fuel; and
        (2) the appropriate companies to include E85 base fuel stationsin updates of global positioning navigation software.

Rules
    Sec. 5. The department may adopt rules under IC 4-22-2 to carryout the duties, purposes, and functions of the department.

Promotion of agricultural business
    Sec. 6. The department shall promote the growth of agriculturalbusinesses by doing the following:
        (1) Assisting agricultural businesses with the permit processrequired to conduct business in Indiana.
        (2) Serving as a liaison between agricultural businesses, stateagencies, and local units of government.

Confidential records
    Sec. 7. The department may keep records submitted to thedepartment by a livestock producer under a voluntary certificationprogram confidential.
