State fair commission established
Sec. 1. (a) The state fair commission is established.
(b) The commission:
(1) is a separate body, corporate and politic;
(2) is not a state agency; and
(3) performs essential governmental functions.

Membership of commission
Sec. 2. (a) The commission consists of eight (8) members asfollows:
(1) Five (5) members appointed by the governor.
(2) The presiding officer of the board.
(3) The director of the Indiana state department of agricultureappointed under IC 15-11-3-1 or the director's designee.
(4) The presiding officer of the trustees elected underIC 15-13-11-7 or the presiding officer's designee who must beselected from the membership of the trustees.
(b) The chairperson of the advisory committee appointed underIC 15-13-6-2(d) or a member of the advisory committee designatedby the chairperson may serve as an ex officio nonvoting member ofthe commission.
(c) Not more than:
(1) one (1) member appointed under subsection (a)(1) mayreside in the same district; and
(2) three (3) members appointed under subsection (a)(1) may beaffiliated with the same political party.
Each district is not required to have a member of the commissionrepresent it.
(d) Two (2) members appointed under subsection (a)(1) must havea recognized interest in agriculture or agribusiness.

Commission; terms; reappointment
Sec. 3. (a) Except as provided in subsection (d), the term of anindividual appointed under section 2(a)(1) of this chapter begins onthe later of the following:
(1) October 1 after the expiration of the term of the memberwhom the individual is appointed to succeed.
(2) The day the individual is appointed by the governor.
(b) The term of a member appointed under section 2(a)(1) of thischapter expires on September 30 of the fourth year after theexpiration of the term of the member's immediate predecessor.
(c) Except as provided in subsection (d), the governor may
reappoint a member appointed under section 2(a)(1) of this chapterfor a new term. A member reappointed by the governor is themember's own:
(1) successor for purposes of subsection (a); and
(2) immediate predecessor for purposes of subsection (b).
(d) An individual may not serve as a member under section2(a)(1) of this chapter for more than eight (8) years in any twelve(12) year period, except as provided in section 4(c) of this chapter.
(e) The member serving under section 2(a)(2) of this chapterserves until the member is not the presiding officer of the board.

Commission; appointments; unexpired terms
Sec. 4. (a) The governor shall appoint an individual qualifiedunder sections 2 and 3 of this chapter to fill a vacancy on thecommission.
(b) An individual appointed by the governor under subsection (a)serves the remainder of the unexpired term of the member theindividual replaces.
(c) The period of the unexpired term for which an individualserves after appointment under this section is not considered indetermining the number of years that a member has served in atwelve (12) year period for purposes of section 3(d) of this chapter.

Appointment of officers
Sec. 5. (a) The governor shall appoint a member appointed undersection 2(a)(1) of this chapter to be the presiding officer of thecommission. The presiding officer of the commission serves until theearlier of the following:
(1) The member's term expires.
(2) The member is replaced as presiding officer by thegovernor.
(b) The commission may elect other officers for the commissionfrom the commission's membership.

Per diem and traveling expenses
Sec. 6. (a) Each member of the commission who is not a stateemployee is entitled to the minimum salary per diem provided byIC 4-10-11-2.1(b). The member is also entitled to reimbursement fortraveling expenses as provided under IC 4-13-1-4 and other expensesactually incurred in connection with the member's duties as providedin the state policies and procedures established by the Indianadepartment of administration and approved by the budget agency.
(b) Each member of the commission who is a state employee isentitled to reimbursement for traveling expenses as provided under
IC 4-13-1-4 and other expenses actually incurred in connection withthe member's duties as provided in the state policies and proceduresestablished by the Indiana department of administration andapproved by the budget agency.

Quorum
Sec. 7. A majority of the members of the commission constitutesa quorum for the transaction of business.

Sec. 8. The commission shall administer this article.

Sec. 9. The commission may adopt rules under IC 4-22-2 toimplement this article.

Executive director
Sec. 10. (a) The commission shall employ an executive directorwho is the chief administrative officer of the commission.
(b) The executive director shall implement the policies of thecommission.
(c) The commission may delegate to the executive director any ofthe commission's powers. The commission may make a delegationunder this subsection by either of the following:
(1) A resolution adopted by the commission.
(2) A rule adopted by the commission under IC 4-22-2.

Staff
Sec. 11. The executive director may hire staff for the commission.

Executive director; delegation of powers
Sec. 12. The executive director may delegate a power or duty ofthe executive director to a member of the staff.

Code of ethics
Sec. 13. (a) The commission shall: (1) adopt:
(A) rules under IC 4-22-2; or
(B) a policy;
establishing a code of ethics for employees of the commission;or
(2) decide it wishes to be under the jurisdiction and rulesadopted by the state ethics commission.
(b) A code of ethics adopted by rules or policy under this sectionmust be consistent with Indiana law and approved by the governor.

Expenses of the commission
Sec. 14. The commission shall pay the expenses of thecommission from the money of the commission, including the fund.

Surety bonds
Sec. 15. (a) Before the issuance of any bonds under this chapter:
(1) the executive director of the commission;
(2) each member of the commission; and
(3) any other employee or agent of the commission authorizedby resolution of the commission to handle funds or sign checks;
shall execute a surety bond in the penal sum of fifty thousand dollars($50,000).
(b) If an individual described in subsection (a)(1) through (a)(3)is already covered by a bond required by state law, the individualdoes not need to obtain another bond if the bond required by statelaw:
(1) is in at least the penal sum specified in subsection (a); and
(2) covers the individual's activities for the authority.
(c) Instead of the surety bond required under subsection (a), thechairperson of the commission may execute a blanket surety bondcovering each member, the executive director, and the employees orother officers of the commission.
(d) A surety bond required under this section must be:
(1) conditioned upon the faithful performance of theindividual's duties; and
(2) issued by a surety company authorized to transact businessin Indiana as a surety.
(e) After the issuance of any surety bonds, the surety bonds mustbe maintained in full force and effect at all times.
(f) The commission shall pay the costs of the surety bonds issuedunder this section.
