Application; forms
Sec. 1. (a) An application for a license under this article must bemade on forms prescribed by the board. The board may adopt a rulethat requires:
(1) the information on the application to be subscribed andsworn to or affirmed before a notary public by the applicant orthe applicant's authorized representative; and
(2) that the affidavit is a component of the application.
(b) The application must include the information required by thisarticle. The board shall use the information from the application andother information as the board considers pertinent to determinewhether a license should be issued, suspended, revoked, or denied.

Foreign corporation consent to service
Sec. 2. (a) Except for an applicant that is a foreign corporation, anonresident applicant for a license under this article must file withthe board an irrevocable consent that specifies the following:
(1) The proceedings against the applicant may be filed in anyappropriate court of any county or municipality in Indianawhere:
(A) the plaintiff resides; or
(B) any part of the transaction occurred out of which thealleged cause of action arose.
(2) The process in any action may be served on the applicant byleaving with the board two (2) copies of the complaint orpleadings that have been filed in an Indiana court.
(3) That the service of process in subdivision (2) is valid andbinding for all purposes.
(b) The board shall promptly forward, by registered mail, one (1)copy of any service of process to the applicant at the address shownon the records of the board.
(c) A foreign corporation may not receive a license under thischapter until it is authorized by the secretary of state to do businessin Indiana.

Rules; renewal
Sec. 3. (a) The board may adopt rules concerning the following:
(1) Annual or biannual renewal of any class of license issuedunder this article.
(2) A common renewal date for each class of license.
(b) The state veterinarian or the state veterinarian's authorizedagent shall sign each license issued by the board.As added by P.L.2-2008, SEC.8.

Refusal for cause
Sec. 4. The board may not refuse to issue a license without cause.

Grounds for denial, suspension, or revocation
Sec. 5. The board may refuse to issue or reissue and may suspendor revoke a license issued under this article for any of the followingreasons relating to the licensee or applicant for a license:
(1) Material misstatement in the application for original license,or in the application for any reissue of a license, under thisarticle.
(2) Violation of this article or of a rule or order of the board.
(3) Abetting another in the violation of this article or of a ruleor order of the board.
(4) Allowing a license issued under this article to be used by anunlicensed person.
(5) Conviction of a crime, an essential element of which ismisstatement, fraud, or dishonesty.
(6) Conviction for violating a law or regulation of another stateor of the United States that is materially similar to a substantiveprovision of this article or a rule of the board.
(7) Suspension or other disciplinary action taken by theSecretary of the United States Department of Agriculture underthe Packers and Stock Yards Acts of 1921 (7 U.S.C. 181through 7 U.S.C. 229), as amended, if it appears that theapplicant or licensee committed or participated in the violationcovered by the disciplinary action.
(8) Material misrepresentation or false promises of a characterlikely to influence, persuade, or induce to action, in connectionwith any business subject to this article.
(9) Failure to possess the qualifications determined by the boardto be necessary or to meet the requirements of this article forthe issuance or holding of a license.

Duty to comply during litigation
Sec. 6. Pending:
(1) a proceeding to suspend or revoke a license issued underthis article; or
(2) an appeal from a decision to suspend or revoke a licenseissued under this article;
each person affected by the proceeding or appeal shall continue tocomply with this article.

Investigations
Sec. 7. The board:
(1) may upon its own motion; and
(2) shall upon a verified written complaint that alleges facts thatwould constitute grounds for refusal, suspension, or revocationof a license under this article;
investigate the actions of an applicant or person holding or claimingto hold a license under this article.

Surrender of license
Sec. 8. After the revocation or suspension of a license, thelicensee must surrender the license to the board. If the licensee failsto surrender the license, the board may seize the license.

Offenses; unlicensed person
Sec. 9. A person who recklessly, knowingly, or intentionallyengages in an activity without a license required for the activityunder this article commits a Class D felony.
