State veterinarian; appointment
    
Sec. 1. (a) The state veterinarian shall be appointed by the boardwith the approval of the governor.
    (b) The state veterinarian serves as the chief administrative officerof the board.

State veterinarian; qualifications
    
Sec. 2. The state veterinarian:
        (1) must:
            (A) be a graduate of a recognized veterinary college;
            (B) be licensed and accredited to practice veterinarymedicine in Indiana; and
            (C) have at least five (5) years experience as a generalpractitioner of veterinary medicine or as a veterinaryadministrator, or both; and
        (2) may not be a member of the board.

Sec. 3. The state veterinarian shall serve a term of four (4) years.

State veterinarian; vacancy
    
Sec. 4. A vacancy in the office of state veterinarian shall be filledfor the unexpired term in the same manner as for a full term.

State veterinarian; duties
    
Sec. 5. The state veterinarian:
        (1) serves as secretary of the board;
        (2) provides technical advice and assistance to the board ofveterinary medical examiners; and
        (3) performs the duties delegated by the board to the stateveterinarian.

Organization of board
    
Sec. 6. The state veterinarian may, subject to the approval of theboard:
        (1) organize the personnel and functions of the board into

divisions and subdivisions;
        (2) delegate responsibilities to the divisions and employees; and
        (3) consolidate, divide, or abolish the divisions andsubdivisions;
as necessary to carry out the state veterinarian's powers and dutiesand the powers and duties of the board.

Sec. 7. The salary of the state veterinarian is fixed by the boardwith the approval of the governor.

Employees; appointment
    
Sec. 8. The board:
        (1) may appoint one (1) assistant state veterinarian; and
        (2) shall appoint other employees necessary to carry out thisarticle.

Employees; nonpartisan
    
Sec. 9. All employees of the board shall be selected on anonpartisan basis and may not be discharged for political reasons.

Employees; salaries
    
Sec. 10. The salary of the employees of the board shall be fixedaccording to IC 4-12-2.

Employees; expenses
    
Sec. 11. Employees are entitled to receive necessarytransportation and per diem expenses while away from theemployees' official station and performing official duties.

Prohibited fees; private practice
    
Sec. 12. (a) An employee may not receive or collect any fee orother payment for any services provided as an employee.
    (b) To learn professional skills and become familiar with newdevelopments in the field of veterinary medicine, the stateveterinarian or other veterinarians employed by the board may, in anindividual capacity as a licensed veterinarian but not in an officialcapacity as a board employee, engage in the private practice of

veterinary medicine if the private practice of veterinary medicinedoes not interfere with the employee's performance of duties as anemployee of the board or does not violate state laws governing ethicsand conflicts of interest.
    (c) The board may impose conditions or restrictions on thepractice of veterinary medicine by the board's employees to facilitatethe performance of board duties and compliance with state ethicslaws.
    (d) The state is not liable for any act performed by the stateveterinarian or a board employee performed in the private practice ofveterinary medicine.

Removal of state veterinarian or employees
    
Sec. 13. (a) The state veterinarian and any other nonmeritemployee may be removed for cause by a majority vote of the entiremembership of the board.
    (b) If the board votes to remove a nonmerit employee, thatemployee must be notified of that decision in writing. Before theremoval of a nonmerit employee becomes effective, the employeehas ten (10) days after receiving written notification to make awritten request for a public hearing regarding the removal. However,the board is not required to hold a hearing unless requested to do soby the nonmerit employee. If a request for a hearing is not made, theremoval is effective upon the expiration of the ten (10) day period.If a request for a hearing is made, a public hearing shall be held atthe office of the board not later than ten (10) days after the requestis received by the board, and the employee may not be removed untilafter the hearing has been held and the board has made a decision.
    (c) A merit employee may be removed under IC 4-15-2.
