    Chapter 2. Indiana Standardbred Advisory Board

"Board"
    
Sec. 1. As used in this chapter, "board" refers to the Indianastandardbred advisory board established by section 2 of this chapter.

Establishment
    
Sec. 2. The Indiana standardbred advisory board is established tomake recommendations to the Indiana horse racing commission (IC4-31-3-1) for the furtherance of the standardbred horse industry inIndiana.

Membership
    
Sec. 3. The Indiana standardbred advisory board consists of seven(7) members selected as follows:
        (1) The chairman of the Indiana horse racing commission, or thechairman's designee, is an ex officio member.
        (2) Two (2) members who are members of county fair boardsappointed by the governor.
        (3) Four (4) members appointed by the governor who have inthe past participated or shown an interest in the standardbredindustry. This interest may, but does not necessarily have to be,evidenced by virtue of being an owner, driver, veterinarian,trainer, or breeder.
Not more than three (3) of the appointees under subdivisions (2) and(3) may be of the same political party as the chairman of the Indianahorse racing commission.

Terms of members
    
Sec. 4. The term of a board member appointed under section 3(2)and 3(3) of this chapter is three (3) years.

Officers; records; location
    
Sec. 5. (a) The advisory board shall elect a chairperson, a vicechairperson, a treasurer, and other officers the board considersnecessary. The chairman of the Indiana horse racing commissionserves as secretary and is entitled to vote on all matters.
    (b) The records of the board shall be kept by the Indiana horseracing commission.
    (c) The office of the board must be at the same location as the

offices of the Indiana horse racing commission.

Quarterly and special meetings
    
Sec. 6. The board shall meet quarterly and at other times as themembers consider necessary. Special meetings may be called by thechairperson or at the written request of at least four (4) membersafter presenting the written request to the secretary. Members mustreceive at least ten (10) days notice before any meeting.

Per diem
    
Sec. 7. Board members, excluding the chairman of the Indianahorse racing commission, are eligible to receive a per diem on daysthe board is in session.

Powers and duties
    
Sec. 8. (a) After considering the recommendations of the board,the Indiana horse racing commission may:
        (1) conduct educational, informational, and youth programs,and sponsor and expend funds for any program and advertisingaimed at promoting the standardbred industry in Indiana;
        (2) employ persons to aid in general promotion or raceadministration programs for the standardbred industry inIndiana;
        (3) prescribe standards for race programs and conditions ofraces, which may include types of races, length of races,positioning of entries, or gait;
        (4) disburse available money to supplement purses for anyindividual race with a cooperating fair or standardbred racemeeting;
        (5) disburse available money to supplement purses for raceshaving the requirement that the entries be owned by legalresidents of Indiana; and
        (6) accept and disburse donations, contributions, appropriations,or grants of money or real or personal property.
    (b) After considering the recommendations of the board, theIndiana horse racing commission shall distribute available money sothat either:
        (1) the division between the trotting and pacing gaits of thestandardbred horse is as near equal as possible in proportion toentries received for any race program; or
        (2) the entries may have been conceived by a stallion thatregularly stands within Indiana and that is listed in thestandardbred registry.
    (c) The Indiana horse racing commission shall establish a

standardbred registry.
    (d) After considering the recommendations of the board, theIndiana horse racing commission shall collect fees for the registrationof standardbred stallions in an amount established by thecommission. However, amounts collected may not exceed fivehundred dollars ($500) per stallion.
    (e) After considering the recommendations of the board, theIndiana horse racing commission shall establish purses for races orto promote races if the races are open to only the offspring ofstandardbred stallions registered under subsection (c).

Division of money
    
Sec. 9. All money that is disbursed as prescribed in section 8 ofthis chapter must be divided so that of all the money dispensed in anyone (1) year:
        (1) at least sixty percent (60%) is supplemented for use inprescribed programs of county and 4-H fairs; and
        (2) not more than forty percent (40%) is used to supplementpurses at the Indiana state fair.

Standardbred horse fund
    
Sec. 10. (a) The standardbred horse fund is established.
    (b) The money received by the Indiana horse racing commissionunder this chapter shall be deposited in the standardbred horse fund.The standardbred horse fund is a nonbudgetary fund. Moneyremaining in the standardbred horse fund at the end of a state fiscalyear does not revert to the state general fund.
    (c) After considering the recommendations of the advisory board,the Indiana horse racing commission may disburse money from thestandardbred horse fund for any purpose described in section 8 ofthis chapter.
    (d) The Indiana horse racing commission shall pay any expenseincurred in administering this chapter from the standardbred horsefund.
