Chapter 10. State Health Data Center

Center defined
Sec. 1. As used in this chapter, "center" refers to the state healthdata center established by this chapter.

Health data defined
Sec. 2. As used in this chapter, "health data" means informationon the following:
(1) A person's:
(A) health status;
(B) ethnicity; and
(C) gender.
(2) The cost, availability, and use of health resources andservices.
The term includes vital statistics and vital records as described in thistitle.

Establishment
Sec. 3. The state department shall establish the state health datacenter.

Duties
Sec. 4. The center shall do the following:
(1) Collect and process health data.
(2) Maintain statistics concerning gender and ethnicity andprovide the information to the state department of healthannually.
(3) Improve the quality, timeliness, and comparability of healthstatistics.
(4) Analyze and disseminate information about the health statusof Indiana residents.
(5) Provide access to health data to persons who are permittedto obtain the data under this chapter.
(6) Support the goals and objectives of the Cooperative HealthStatistics System established by the federal National Center forHealth Statistics.

Rules
Sec. 5. (a) Except as provided in subsection (b), the state
department shall adopt rules under IC 4-22-2 to carry out thischapter.
(b) The state department may not adopt a rule that restricts aperson's access to health data unless the right to inspect and copy thathealth data is specifically restricted by statute.

State department surveys; confidentiality
Sec. 6. (a) The state department may conduct surveys:
(1) concerning the health status of Indiana residents; and
(2) evaluating the effectiveness of the state department'sprograms.
(b) Information contained in a survey described in subsection (a)that identifies or could be used to determine the identity of a personresponding to the survey is confidential. All other informationcontained in the survey is not confidential and is available forinspection and copying under IC 5-14-3.
(c) For purposes of this section, "survey" does not include data orinformation that is generated, collected, or transferred underIC 16-21-6-7 or IC 16-39-5-3.

Medical or epidemiological information; form of disclosure;consent
Sec. 7. (a) This section does not apply to medical orepidemiological information protected from disclosure underIC 16-41-8-1 or data or information that is confidential underIC 16-21-6-7 or IC 16-39-5-3.
(b) Except as provided in subsection (c), medical orepidemiological information:
(1) collected from or volunteered by a person; and
(2) that results in or from:
(A) a public health surveillance;
(B) a public health investigation; or
(C) an epidemiological investigation or study;
may be released only in a form that protects the identity of a personwhose medical or epidemiological information was obtained.
(c) Medical or epidemiological information described insubsection (b) may be released in a form that does not protect theidentity of a person whose medical or epidemiological informationwas obtained if:
(1) the person consents in writing to the release of the person'smedical or epidemiological information; or
(2) the investigation or study results in an administrative or ajudicial proceeding and release of the medical orepidemiological information is ordered by the administrativelaw judge or the court.

Counterterrorism symptom and health syndrome data collection
Sec. 8. (a) The state department shall support the goals andobjectives of the state's counterterrorism programs by collecting datarelated to:
(1) symptoms; and
(2) health syndromes;
from outbreaks or suspected outbreaks of diseases or other healthconditions that may be a danger to public health.
(b) A health care provider or other entity that collects datadescribed in subsection (a) shall report to the state department inaccordance with rules adopted under section 5 of this chapter.
(c) The state department shall establish reporting, monitoring, andprevention procedures for data collected under this section.
(d) Data:
(1) collected under subsection (a); or
(2) reported under subsection (b);
from which the identity of an individual may be ascertained areconfidential.
