    Chapter 3. Remedies for Violations

IC 16-21-3-1
Civil penalty, license revocation, or other possible actions
    
Sec. 1. The state health commissioner may take any of thefollowing actions on any of the grounds listed in section 2 of thischapter:
        (1) Issue a letter of correction.
        (2) Issue a probationary license.
        (3) Conduct a resurvey.
        (4) Deny renewal of a license.
        (5) Revoke a license.
        (6) Impose a civil penalty in an amount not to exceed tenthousand dollars ($10,000).

Grounds for action
    
Sec. 2. The state health commissioner may take action undersection 1 of this chapter on any of the following grounds:
        (1) Violation of any of the provisions of this chapter or of therules adopted under this chapter.
        (2) Permitting, aiding, or abetting the commission of any illegalact in an institution.
        (3) Knowingly collecting or attempting to collect from asubscriber (as defined in IC 27-13-1-32) or an enrollee (asdefined in IC 27-13-1-12) of a health maintenance organization(as defined in IC 27-13-1-19) any amounts that are owed by thehealth maintenance organization.
        (4) Conduct or practice found by the council to be detrimentalto the welfare of the patients of an institution.

Sec. 3. IC 4-21.5 applies to an action under this chapter.

Revocation of hospital license for cloning
    
Sec. 4. Notwithstanding section 1 of this chapter, the statedepartment shall revoke the license of a hospital licensed under thisarticle if, after appropriate notice and an opportunity for a hearing,the state health commissioner proves by a preponderance of theevidence that the hospital:
        (1) knowingly allows the hospital's facilities to be used forcloning or attempted cloning; or
        (2) knowingly allows the hospital's employees, in the course ofthe employee's employment, to participate in cloning or

attempted cloning.
